The situation
When an Austrian tax file needs a lawyer
A tax assessment, an audit finding or a penalty notice from the Austrian tax administration usually arrives with reasoning attached and a route to challenge it. If a figure looks wrong — or if you are new to Austria, work across borders or hold property here — the practical question is who reads the file with you. We match you with an income tax lawyer in Austria whose practice covers exactly that: appeals against assessments, support during an audit, and representation in proceedings before the fiscal courts. You do not need to know the procedure first. Describe the situation, say where in Austria the matter sits, and we introduce suitable lawyers. The first introduction is free and carries no obligation.
Austria in practice
How tax disputes and legal representation work in Austria
The points below set out how Austrian procedure actually works around a tax file: which courts decide fiscal disputes, who is allowed to practise, which representation rules apply, and how costs and legal aid fit together. The table lists the general civil limitation periods and procedural deadlines taken from the Austrian sources cited at the end of this page.
Tax disputes follow the administrative court route
Austria separates its court system: the ordinary courts handle civil and criminal matters, while administrative disputes — including tax matters — go before the administrative courts. The Bundesfinanzgericht (Federal Fiscal Court) decides fiscal cases at first instance, with the Verwaltungsgerichtshof and the Verfassungsgerichtshof above it. A lawyer prepares the complaint, frames the legal grounds and manages the file from the authority’s decision onwards.
Who may practise as a Rechtsanwalt
Only a lawyer entered in the list of the regional Bar association (Rechtsanwaltskammer) may practise as a Rechtsanwalt; membership is compulsory under the Rechtsanwaltsordnung, and the title is protected by law. The route requires an Austrian law degree of at least 240 ECTS, five years of practical training including court and law-firm stages, and the bar examination. Professional liability insurance is mandatory.
One lawyer, all courts and authorities
A Rechtsanwalt is entitled to appear before all courts and authorities in Austria. In civil litigation, representation is mandatory before the regional courts and all higher courts, and before the district courts where the amount in dispute exceeds €5,000. In tax matters, the same right of representation means your lawyer can correspond with the tax office and argue before the fiscal courts without a separate appointment.
What legal costs look like
Fees for representation before courts and authorities follow the Lawyers’ Tariff Act (Rechtsanwaltstarifgesetz) and the General Fee Criteria, usually scaled to the value in dispute, while out-of-court work is often billed hourly. Lawyer and client may agree different terms, including hourly rates and success fees, in writing. Court fees under the Gerichtsgebührengesetz are generally payable when a claim is filed, and the losing party bears the costs under the Zivilprozessordnung.
Legal aid for those who cannot meet the costs
Legal aid (Verfahrenshilfe) is granted by the court on application to a party who cannot meet the costs of proceedings without impairing their necessary maintenance. The case must not be frivolous or without prospect of success. Aid covers exemption from court fees and, where a lawyer is required, the free provision of one; it must be repaid if the party’s finances improve, up to three years after the proceedings end.
Inheritance and gifts: what changed in 2008
Since 1 August 2008 Austria has levied no inheritance tax or gift tax at federal level, after the Constitutional Court struck down the core provisions of the Inheritance and Gift Tax Act. Inheritances and gifts therefore no longer carry that charge, but transfers of real property still trigger real-property transfer tax and a land-register entry fee, and larger lifetime gifts may carry a reporting obligation.

Common problems
What clients bring to us
These are the situations people describe most often when they write to us about an Austrian tax matter.
The notice is in German and full of references
An assessment or audit notice arrives in German, citing provisions you have never seen. Reply in the wrong form, or to the wrong body, and the file becomes harder to fix. A lawyer reads it, identifies the grounds and responds in the correct procedural form.
Two countries, one income
You live in Austria and earn abroad, or you live abroad and own Austrian property. Two tax administrations may look at the same income. A lawyer used to cross-border files can map the questions before you answer either authority.
You cannot tell what it will cost
Austrian fees follow a published tariff for court work, but out-of-court advice is often billed hourly, and terms can be agreed in writing. Instead of guessing, ask each lawyer how they charge, what the first steps cost and whether legal aid could apply.
How we help
What the matching service gives you
We are not a law firm. We find the right Austrian practice for your matter and put you in direct contact with it.
Matched on the actual issue
We do not send a generic list. Tell us whether the problem is an assessment, an audit, a cross-border question or a property transaction, and we look for lawyers whose Austrian practice covers that specific area.
Austrian qualification checked
Every lawyer we introduce is entered in the list of a regional Bar association and is entitled to appear before all Austrian courts and authorities, which is the basis on which the Rechtsanwaltsordnung permits practice in Austria.
One free first step
Describing your case and receiving introductions costs nothing and commits you to nothing. You decide afterwards whether to instruct a lawyer, and on what terms; fees in Austria can be agreed in writing, including hourly billing.
Local knowledge, national coverage
Tax files are handled from Vienna, Graz, Linz, Salzburg, Innsbruck and the other federal states, and an admitted Rechtsanwalt may appear before authorities across the whole country, so your choice of lawyer is rarely limited by geography.

Questions
Income tax and procedure in Austria: frequent questions
Do I need an income tax lawyer in Austria, or can I handle the appeal myself?
You are free to answer the tax office yourself. Where a case reaches the Federal Fiscal Court, however, it turns on legal grounds, evidence and procedural form, and an income tax lawyer in Austria prepares and argues that on your behalf. A first review of the file usually shows how strong the position looks and what the next step should be.
Which Austrian court decides tax disputes?
Administrative disputes in Austria are handled separately from the ordinary courts. The Bundesfinanzgericht (Federal Fiscal Court) is the administrative court for fiscal matters, and above it sit the Verwaltungsgerichtshof and, on constitutional questions, the Verfassungsgerichtshof. The ordinary courts deal with civil and criminal cases.
Must a lawyer represent me in Austrian civil proceedings?
In civil litigation, representation by a lawyer is mandatory before the regional courts and all higher courts, and before the district courts where the value in dispute exceeds €5,000. Below that threshold you may appear in person before the district court. Once instructed, a Rechtsanwalt may appear before all courts and authorities in Austria.
What does a lawyer cost in Austria?
Lawyers’ fees for court and authority work follow the Lawyers’ Tariff Act (Rechtsanwaltstarifgesetz) and the General Fee Criteria, usually scaled to the value in dispute, while out-of-court work is often billed hourly. You and your lawyer may agree different terms, including hourly rates and success fees, in writing. Court fees fall under the Court Fees Act and the losing party normally bears the costs.
Can I get legal aid for a tax or civil case in Austria?
Legal aid (Verfahrenshilfe) is granted by the court on application if you cannot meet the costs of proceedings without impairing the necessary maintenance of yourself and your family, and the case is not frivolous or without prospect of success. It covers exemption from court fees and, where a lawyer is required, the free provision of one. It is repayable if your finances improve, up to three years after the proceedings end.
Are gifts and inheritances taxed in Austria?
Since 1 August 2008 Austria has levied no inheritance tax or gift tax at federal level, after the Constitutional Court struck down the core provisions of the Inheritance and Gift Tax Act. Inheritances and gifts are therefore not taxed as such. Transfers of real property still trigger real-property transfer tax and a land-register entry fee, and larger lifetime gifts may carry a reporting obligation.
