Understanding your position

Why clients search for an income tax lawyer in Bulgaria

Bulgaria applies a flat 10% tax on personal income and a flat 10% corporate income tax, with dividends taxed at 5% and non-resident individuals taxed at 10% on Bulgarian-source income. The rates are simple; the situations around them often are not. Rental income, foreign employment, share disposals, permanent-establishment exposure or an assessment from the revenue authorities all raise questions that depend on how the Personal Income Tax Act is applied to your facts. If you live in Sofia, Plovdiv, Varna or abroad with Bulgarian income, you need someone who works with these rules regularly. We are not a law firm and we do not give advice. We match you, free of charge, with an income tax lawyer in Bulgaria who handles the matter you describe, so you can compare and choose.

Bulgaria in practice

How Bulgarian tax work is handled locally

Tax matters in Bulgaria sit inside a continental civil-law system with codes and specialised courts. The points below describe how the country’s framework actually operates, so you know what to expect before you speak to a lawyer.

One flat rate, several different taxes

Bulgaria has one of the lowest tax regimes in the EU: a flat 10% tax on personal income under the Personal Income Tax Act and a flat 10% corporate income tax, with no progressive brackets. Dividends are taxed at 5%, and non-resident individuals are taxed at 10% on their Bulgarian-source income. This structure is a key reason cross-border clients consider relocation, employment or investment in Bulgaria.

Who may practise as your lawyer

Only a person who has taken the statutory oath and is entered in the register of a Bar Association may practise as an attorney-at-law, and the profession is reserved to attorneys-at-law and registered EU lawyers under the Bar Act. Admission requires a Master’s degree in law, legal capacity, at least two years of legal service record and success in the bar examination. The Supreme Bar Council keeps the single register.

Where tax disputes are decided

Administrative justice in Bulgaria is administered by the administrative courts and, at the top, by the Supreme Administrative Court. Challenges to administrative acts follow the Administrative Procedure Code. Representation by an attorney-at-law is mandatory in proceedings before the Supreme Administrative Court, which is where tax disputes can ultimately end up.

State fees and lawyers’ fees

State court fees in civil proceedings are set by the Schedule of state fees collected by the courts. For a standard monetary claim the fee is 4% of the value of the claim, subject to a minimum of BGN 50, while order-for-payment proceedings carry a fee of 2% of the material interest. Lawyers’ fees are freely agreed; the Supreme Bar Council publishes non-binding reference amounts.

Costs, legal aid and who pays

The losing party in civil proceedings is generally ordered to reimburse the winning party’s reasonable fees and costs. State-funded legal aid, administered by the National Legal Aid Bureau under the Ministry of Justice, is available to persons meeting statutory income and means criteria and to certain categories of persons; amendments of 16 December 2022 broadened both its scope and the range of eligible persons.

Property transactions and the tax file

Transfers or encumbrances of real property must be effected by a notarial deed before a notary public competent for the property’s location, and the deed must be entered in the Property Register to be effective against third parties. Since 1 July 2011, payments in real-estate transactions above BGN 10,000 must be made through a special bank account. These formalities feed directly into property-income and capital-gains questions.

Common situations

What people bring to a Bulgarian tax lawyer

Most enquiries we receive fall into a few recognisable patterns. Yours does not have to fit one of them.

01

You received a decision you disagree with

Revenue decisions and other administrative acts can be challenged, but the window is short. Clients often need help understanding the grounds and preparing the challenge before time runs out.

02

Your income crosses borders

You work or invest in Bulgaria while living elsewhere, or you live in Bulgaria with foreign income. Questions about source, residence and double taxation need a lawyer who reads these files regularly.

03

Your business structure raises tax questions

Company profits, dividends, director remuneration and permanent-establishment risk interact. Founders want clarity before they commit, not after an assessment arrives.

How matching works

Why clients use our free matching service

We are a matching platform, not a law firm. Our role is to put your matter in front of lawyers who actually handle it.

Matter-first matching

You describe the tax issue in your own words. We route it to lawyers whose practice covers personal income tax, corporate tax or tax disputes rather than to general practitioners.

English-speaking lawyers

Bulgarian court proceedings are conducted in Bulgarian, so cross-border clients value lawyers who can explain the file, the documents and the next steps in clear English.

You stay in control

There is no obligation to instruct anyone you are matched with. You compare experience, approach and cost expectations, then decide whether to proceed.

Confidential by default

Your enquiry is treated confidentially and shared only with the lawyers relevant to your matter. You choose how much detail to give at the first contact.

Questions and answers

Frequently asked questions about Bulgarian income tax

How do I choose an income tax lawyer in Bulgaria?

Start from the nature of your matter: personal income, corporate profits, cross-border exposure or a dispute with the revenue authorities. Only attorneys-at-law entered in a Bar Association register may practise in Bulgaria, so check that the lawyer is registered. We match you with lawyers whose practice already covers your type of file, and you decide whether to instruct.

What tax rates apply to individuals in Bulgaria?

Bulgaria applies a flat 10% tax on personal income under the Personal Income Tax Act, with no progressive brackets. Dividends are taxed at 5%, and non-resident individuals are taxed at 10% on their Bulgarian-source income. Corporate profits are also taxed at a flat 10%. A lawyer can explain how these rates apply to your particular situation.

Can a tax decision be challenged in court?

Administrative acts, including tax decisions, follow the Administrative Procedure Code, and administrative justice is administered by the administrative courts with the Supreme Administrative Court at the top. Administrative appeal and judicial review of an administrative act are subject to a 14-day period, so it is important to act quickly and seek advice as soon as you receive the decision.

Do I need to be in Bulgaria to work with a lawyer?

Not necessarily. Many cross-border clients handle the first stages remotely, sharing documents and discussing the matter online or by telephone. Where a hearing or a notarial formality is required, however, proceedings before Bulgarian courts are conducted in Bulgarian, and representation by an attorney-at-law is mandatory before the Supreme Administrative Court.

What does it cost to bring a tax matter before a Bulgarian court?

State court fees in civil proceedings are set by the Schedule of state fees collected by the courts. A standard monetary claim carries a fee of 4% of the value of the claim, with a minimum of BGN 50, and order-for-payment proceedings carry 2% of the material interest. Lawyers’ fees are freely agreed between lawyer and client, and the losing party is generally ordered to reimburse reasonable costs.

Is legal aid available for tax disputes in Bulgaria?

State-funded legal aid exists under the Legal Aid Act of 2005 and is administered by the National Legal Aid Bureau under the Ministry of Justice. It is available to persons who meet statutory income and means criteria and to certain categories of persons, and amendments of 16 December 2022 broadened both its scope and the range of eligible persons. Eligibility depends on your circumstances.
