Why this matters
Italian income tax problems need an Italian lawyer
A tax assessment, a dispute about income you earned in Italy or a cross-border question about where you should be taxed can be difficult to handle alone, especially in a codified civil law system with a specialised court structure. An income tax lawyer in Italy works within that structure: tax disputes are heard by the special tax jurisdiction, and in most proceedings only a lawyer registered in the albo degli avvocati may represent you. Finding the right one is the hard part. Tell us about your notice, your appeal or your question, and we will connect you free of charge with a lawyer who handles income tax matters in Italy and can explain your position clearly. You do not need to know which court or which office is involved — that is what the lawyer is for.
Italy in practice
How tax matters and legal procedure work in Italy
Italy is a civil law jurisdiction whose core rules are codified, and its courts are divided between ordinary and special jurisdictions. If you are dealing with income tax, these are the practical points that shape how a lawyer will work on your file.
A separate tax jurisdiction
Italy is a civil law country whose core sources are codified, and judicial power is divided between ordinary and special courts. Tax disputes are heard by the special tax jurisdiction, the Corti di giustizia tributaria, distinct from the ordinary civil courts and from the administrative TAR. Above them, the Corte Suprema di Cassazione in Rome reviews questions of law only.
Who may practise as your lawyer
Practising as an avvocato requires registration in the albo degli avvocati kept by the territorial Consiglio dell’Ordine; the national body is the Consiglio Nazionale Forense. Under Law 247/2012, admission requires Italian or EU citizenship, a five-year law degree (laurea magistrale in giurisprudenza), an 18-month traineeship with a qualified lawyer and the State examination.
Representation before the courts
Under art. 82 of the Code of Civil Procedure you may appear in person only before the Giudice di Pace, in claims worth no more than EUR 1,100; in all other civil proceedings a qualified difensore is mandatory. In criminal cases a defence lawyer is always required, and appeals to the Corte di Cassazione are reserved to lawyers on the special albo dei cassazionisti.
Fees, court charges and how they are set
Since minimum fees were abolished in 2006 there is no binding statutory tariff: lawyers’ fees are freely agreed with the client, and where there is no agreement the court liquidates them using the ministerial parametri forensi (D.M. 55/2014), which set minimum and maximum reference values by phase of the proceedings. Court proceedings also carry the contributo unificato.
Legal aid: patrocinio a spese dello Stato
Where your annual taxable income does not exceed EUR 12,838.01, legal aid (patrocinio a spese dello Stato) covers court fees and the lawyer’s fees in civil and administrative cases, under the decree of 10 May 2023. It is available to Italian citizens, EU and non-EU nationals regularly resident in Italy, stateless persons and non-profit entities.
Prescrizione and decadenza: why the clock matters
Italian law distinguishes prescrizione, a limitation period that may be interrupted or suspended, from decadenza, a forfeiture term that is strict and cannot be interrupted. The ordinary limitation period is ten years, while five years applies to tort claims and to periodic payments, interest and rents. Many procedural challenge terms are forfeiture terms.
The country information on this page is drawn from official Italian sources — the Consiglio Superiore della Magistratura, the Consiglio Nazionale Forense, the Ministry of Justice and Normattiva — consulted in 2025.

Common situations
What people bring to us
Most clients arrive with a document in one hand and no clear idea of what happens next. These are the three situations we see most often.
You have a tax notice you do not understand
Notices and assessments arrive in formal Italian, sometimes with terms that are forfeiture deadlines rather than simple limitation periods. Missing a step can narrow your options before you have had a chance to explain your position.
You live abroad but earned income in Italy
Cross-border income raises questions about which country taxes what. You need a lawyer who can read the Italian file, deal with the authorities and then explain the position to you in language you actually understand.
You do not know who to trust or what it should cost
Fees in Italy are freely agreed between lawyer and client, so quotes vary widely. Without a clear picture of the market you risk overpaying — or choosing someone without real experience of tax proceedings.
How we help
What you get from our matching service
We are not a law firm. We are a free introduction service that helps you find a lawyer suited to your Italian income tax problem.
Matched with a registered avvocato
Every lawyer we introduce is registered in the albo degli avvocati kept by a territorial Consiglio dell’Ordine, which is the legal precondition for practising as an avvocato in Italy.
Experience with Italian tax proceedings
We look for lawyers who handle income tax work and appear before the Corti di giustizia tributaria, so your file is dealt with by someone familiar with the procedure rather than a generalist.
Clear costs before you commit
Italian fees are agreed freely, so you can ask for a written quote. We explain how the contributo unificato and the ministerial parametri forensi work before you decide whether to instruct.
Support in a language you speak
Court proceedings are conducted in Italian, with German co-official in Trentino-Alto Adige/Südtirol and French in Valle d’Aosta. Where possible we match you with a lawyer who can also explain matters in your language.

Questions and answers
Income tax lawyers in Italy: what clients ask
How do I find a reliable income tax lawyer in Italy?
Start by checking that the lawyer is registered in the albo degli avvocati kept by a territorial Consiglio dell’Ordine degli Avvocati — registration is a legal precondition to practise as an avvocato in Italy. Then ask about experience before the Corti di giustizia tributaria. Our free matching service takes both points into account.
Do I need an Italian-qualified lawyer to represent me before a tax court?
Registration in the Italian bar is a legal precondition to act as an avvocato and to use that title. Under art. 82 of the Code of Civil Procedure, parties may appear in person only before the Giudice di Pace in claims worth no more than EUR 1,100; otherwise a qualified difensore is mandatory. Cassazione appeals are reserved to cassazionisti.
What deadlines should I watch in an Italian matter?
Italian law separates prescrizione, which may be interrupted or suspended, from decadenza, a strict forfeiture term that cannot. The ordinary limitation period is ten years; five years applies to tort claims and to periodic payments, interest and rents. An administrative appeal to annul an act must be brought within 60 days. Your lawyer will confirm the term on your file.
How much does an Italian lawyer cost for a tax matter?
There is no binding statutory tariff: since minimum fees were abolished in 2006, fees are freely agreed with the client. Where no agreement exists, the court liquidates fees using the ministerial parametri forensi (D.M. 55/2014), which set minimum and maximum values by phase. Proceedings also carry the contributo unificato and a EUR 27 marca da bollo.
Can I get legal aid for a tax case in Italy?
Legal aid (patrocinio a spese dello Stato) covers court fees and the lawyer’s fees where annual taxable income does not exceed EUR 12,838.01, under the decree of 10 May 2023 for civil and administrative cases. It is open to Italian citizens, EU and non-EU nationals regularly resident in Italy, stateless persons and non-profit entities. Ask your lawyer to check eligibility.
What language will my Italian case be conducted in?
Italian is the language of the courts, with German co-official in Trentino-Alto Adige/Südtirol and French co-official in Valle d’Aosta. Written submissions and hearings will normally be in Italian, so you need a lawyer who can handle the file there and then explain it to you clearly. We take language into account when matching.
