Why this page exists

A tax problem in Albania is also a legal problem

An income tax question rarely stays a tax question. A disputed assessment, a penalty or a refund that has stalled can reach into your company accounts, your property and your personal exposure, and in Albania those threads run through a legal system with its own courts, limitation periods and formalities. That is where an income tax lawyer in Albania earns their place: someone who reads the file as a lawyer, knows what the administrative courts expect, and explains your realistic options in plain language. Our platform is a free matching service. You describe your situation in a few minutes, and we introduce you to an Albanian lawyer whose practice covers tax and administrative work. No obligation, and no cost to be matched.

Albania in practice

How tax-related legal work works in Albania

Albania follows the continental civil-law tradition, with the 1998 Constitution as the highest authority and ratified international agreements prevailing over domestic law. Its judiciary was reshaped by the 2016 justice reform, which created new self-governing councils and rebuilt the court structure. These are the features that most affect a tax or administrative file.

Who is allowed to practise as a lawyer in Albania

The profession of avokat is regulated by Law no. 55 of 23.7.2018. A candidate must hold the integrated university degree in law (Master), complete a one-year internship as an assistant lawyer in a lawyer’s office, pass the bar qualification examination and be registered in the register kept by the National Chamber of Advocacy (Dhoma Kombëtare e Avokatisë), whose membership is compulsory in order to practise. The Chamber also administers continuing education and the disciplinary system for the profession.

Where disputes with public authorities are decided

Albania’s ordinary courts are complemented by specialised administrative courts: the Administrative Court of First Instance and the Administrative Court of Appeal, both seated in Tirana, with jurisdiction over administrative matters. Above them sits the Administrative Chamber of the High Court. Matters involving the tax administration therefore run in their own stream, separate from ordinary civil claims, which shapes both the forum and the way a file is argued.

Representation and powers of attorney

Under Articles 22–23 of the Code of Civil Procedure, parties may defend themselves personally except where the law requires mandatory representation, and are otherwise free to appoint a lawyer or another authorised representative. Representation by a lawyer is required before the higher courts. A power of attorney authorising a representative to act before the courts must, as a rule, be made by notarial act under Article 72 of the Civil Code.

Court fees and lawyers’ fees

Court fees are governed by Law no. 98/2017 and are generally calculated on the value of the case, subject to statutory minimum and maximum amounts that differ by instance; they are normally paid when the lawsuit, appeal or request is filed. Lawyers’ fees, by contrast, are freely agreed in writing between lawyer and client — Albania has no binding official tariff for private legal services. A losing party may be ordered to reimburse procedural costs.

State-guaranteed legal aid

Law no. 111/2017 established a state-guaranteed legal aid system with two levels: primary legal aid covering information, advice and assistance outside court, and secondary legal aid covering representation by a lawyer in court. Beneficiaries are also exempted from court fees and enforcement costs. The system is administered by the Free Legal Aid Directorate of the Ministry of Justice and is available to persons with limited means and to specified vulnerable groups.

Time limits and court capacity after the 2016 reform

Related civil claims carry their own limitation periods — ten years for general contractual claims, three years for tort and unjust enrichment, five years to annul a transaction — so delay can quietly extinguish a strong position. Court staffing and case-processing times were affected by the 2016 reform and the vetting of judges and prosecutors, which is a practical reason to put a file in order early rather than late.

The country information on this page is drawn from official Albanian and Council of Europe sources — the CEPEJ country profile for Albania, the Ministry of Justice texts of Laws no. 55/2018 and no. 111/2017, and the Civil Code and Code of Civil Procedure as published by WIPO Lex — consulted in 2026.

Common situations

What clients bring to us

Most people who contact us are not looking for a textbook answer. They are looking for someone who will take the file, read it properly and tell them where they stand.

01

A letter you did not expect

An assessment, a penalty notice or a request for documents arrives with a short reply window. You need to understand what is actually being claimed before you answer anything in writing.

02

A dispute that keeps growing

What began as a small correction has become a running argument with interest and additional charges attached. Without a legal strategy, each exchange tends to make the position harder to unwind.

03

You do not know whom to ask

Your accountant handles the numbers, but the question is now legal — which forum, which documents, which formalities. You need a lawyer who works on Albanian tax and administrative matters.

How we help

Matched with a lawyer, not a call centre

Our role is narrow and deliberate: we listen to your situation and introduce you to an Albanian lawyer whose practice fits it. Everything after that is between you and your lawyer.

Free and without obligation

Being matched costs you nothing, and you decide whether to instruct the lawyer we introduce. There is no subscription and no hidden charge for the introduction itself.

Lawyers who know the forum

Albanian tax and administrative matters run through specialised courts seated in Tirana. We look for practitioners who are used to working in that stream rather than in ordinary civil litigation.

A clear first conversation

You explain the situation once, in your own words. Your matched lawyer can then tell you what the file looks like from a legal standpoint and what the practical steps would be.

Confidential by design

What you send us is used to identify a suitable lawyer and nothing else. You share the details of your case with that lawyer directly, under professional confidentiality.

Questions and answers

Income tax lawyers in Albania: what clients ask

How do I find an income tax lawyer in Albania?

You tell us briefly what the matter concerns — an assessment, a penalty, a refund, a dispute with a public body — and we match you with an Albanian lawyer whose practice covers tax and administrative work. Lawyers must be registered with the National Chamber of Advocacy in order to practise, so registration is a basic check we apply.

Which courts hear disputes with the Albanian tax administration?

Albania has specialised administrative courts separate from the ordinary civil courts: the Administrative Court of First Instance and the Administrative Court of Appeal, both seated in Tirana, with the Administrative Chamber of the High Court above them. Matters involving a public authority are dealt with in that stream, which affects how a file is prepared and argued.

Do I have to be represented by a lawyer in Albanian proceedings?

Not always. Under the Code of Civil Procedure, parties may defend themselves personally unless the law requires mandatory representation, and are otherwise free to appoint a lawyer or another authorised representative. Representation by a lawyer is required before the higher courts. A power of attorney to act before the courts must, as a rule, be made by notarial act.

What does a tax lawyer cost in Albania?

Lawyers’ fees are freely agreed in writing between lawyer and client, because Albania has no binding official tariff for private legal services. Court fees are separate and follow Law no. 98/2017, generally calculated on the value of the case with statutory minimums and maximums. A losing party may be ordered to reimburse procedural costs.

Is legal aid available for tax-related disputes in Albania?

Law no. 111/2017 provides state-guaranteed legal aid in two levels: primary aid such as information, advice and assistance outside court, and secondary aid covering representation by a lawyer in court. Beneficiaries are also exempted from court fees and enforcement costs. Eligibility depends on means and, for certain categories, on vulnerability.

How long do I have to bring a related civil claim?

It depends on the type of claim. Albanian limitation periods include ten years for general contractual and civil claims, three years for tort and unjust enrichment, two years for insurance compensation, one year for non-property damage and five years to annul a transaction. Because these periods are not uniform, timing should be reviewed early with your lawyer.
