Injury claims inside a civil law system
A road collision, a fall in a shop or an accident at work can leave you with injuries, lost income and costs you never planned for. In Azerbaijan, claims of this kind are decided within a civil law system built on the Constitution of 12 November 1995 and on codified legislation, and court proceedings are conducted in Azerbaijani. Whether you were hurt in Baku, Ganja, Sumgayit or a smaller regional town, the practical questions stay the same: who was at fault, what loss can be shown, and how much time you have to act. We are not a law firm. We listen to your account, then match you with a personal injury lawyer in Azerbaijan whose practice fits your situation — and the first match costs you nothing.
Azerbaijan in practice
How injury matters work before Azerbaijani courts
Azerbaijan is a civil law jurisdiction: judicial power is exercised only by the courts under Article 125 of the Constitution, and the language of the courts is Azerbaijani. The facts below describe the framework your claim will sit inside; they are drawn from official sources.
Which courts will hear your claim
Judicial power is exercised by the Constitutional Court, the Supreme Court, the courts of appeal and the general and specialised courts. First-instance work sits mainly with 86 district (city) courts, alongside grave crimes, military, administrative and commercial courts. There are five courts of appeal — Baku, Ganja, Sumgayit, Shirvan and Sheki — and the Supreme Court acts as the cassation instance.
Who may represent you in court
Representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association, following amendments of 31 October 2017. Bar membership is therefore effectively compulsory for court advocacy. The Association is a self-regulating body of roughly 3,003 members, with 103 law offices in Baku and 41 in the regions.
How an Azerbaijani advocate qualifies
Admission requires a higher legal education, at least three years of legal work experience, a qualification examination made up of a written test and an interview before the Lawyers’ Qualification Commission, and successful completion of compulsory training at the Justice Academy of the Ministry of Justice. Candidates previously working as lawyers or judges may be admitted by interview alone.
What you pay to bring a case
Civil claims for property are subject to a state duty under the Law ‘On State Duty’, calculated as a percentage of the value of the claim on a sliding scale, with statutory minimum and maximum amounts. The judicial authorities publish an official online calculator at e-mehkeme.gov.az. Lawyers’ fees are not tariffed; they are freely agreed between lawyer and client.
Time limits and evidence
The general limitation period is 10 years, notably long by regional standards, while contractual claims are limited to three years and contracts concerning immovable property to six. Periodically performable obligations such as rent or alimony instalments fall under three years. Longer periods still require you to preserve medical records, accident reports and receipts.
Language, notaries and legal aid
Azerbaijani is the official language of the Republic and of its courts, so documents and hearings will generally be in Azerbaijani. Notarial acts are subject to state duty, and the Chamber of Notaries maintains the notary system, with a range of services available electronically. Free state-funded legal aid is provided through the Legal Aid Centre of the Bar Association.
All figures on this page are taken from official Azerbaijani and international sources — the Supreme Court, the Azerbaijani Bar Association, the Civil Code, NATLEX and the Chamber of Notaries — consulted in 2025.

Common situations
Why injury claims stall in Azerbaijan
Most delays are practical, not legal. These are the three patterns we see most often.
You do not know where to start
Accident, hospital, insurer, employer — the paperwork piles up while you are still recovering. Without a clear sequence of steps, months can pass before anything is formally filed with a court.
Court representation is qualified
In civil and administrative proceedings, representation is reserved to advocates who are members of the Azerbaijani Bar Association. A friend, an insurer’s adviser or an unregistered helper cannot stand for you before the court.
Deadlines are easy to misjudge
The general limitation period in Azerbaijan runs to ten years, but contractual claims fall under three years and some obligations under three years as well. Assuming one rule fits every situation is a common and costly error.
How matching works
What you get from our service
We do not practise law. We remove the search problem so you can speak to the right advocate quickly.
A practice-area match
We route your description to advocates whose work covers personal injury and civil compensation, not to general practitioners who see such files rarely.
A clear first conversation
You explain the accident in your own words. The advocate confirms whether the file fits their practice and what information they would need to assess it.
Fees agreed in advance
There is no statutory tariff for lawyers’ fees in Azerbaijan; they are freely agreed. You can therefore settle the basis of the engagement directly with the advocate before any work begins.
No cost to be matched
Matching is free and carries no obligation. If the first advocate is not the right fit, tell us and we will look for another match.

Questions
Frequently asked questions
Do I need a personal injury lawyer in Azerbaijan, or can I handle it myself?
You may file and pursue a civil claim yourself, but representation before the courts in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. If your matter is likely to reach a courtroom, engaging a qualified advocate early usually avoids procedural problems later.
How much time do I have to bring an injury claim in Azerbaijan?
The general limitation period is 10 years under Article 373.1 of the Civil Code, which is longer than in many civil-law systems. Contractual claims are limited to three years, and contracts concerning immovable property to six years. Periodically performable obligations also fall under three years, so the period depends on how the claim is framed.
In which language are Azerbaijani court proceedings conducted?
Azerbaijani is the official language of the Republic under Article 21 of the Constitution, and it is the language of the courts. Pleadings, evidence and hearings will generally be in Azerbaijani, which is why documents drafted in another language usually need proper translation before they can be used.
Which courts deal with claims arising from accidents in Azerbaijan?
First-instance civil work is handled mainly by the 86 district (city) courts, with dedicated administrative and commercial courts for those matters. Appeals go to one of the five courts of appeal — Baku, Ganja, Sumgayit, Shirvan and Sheki — and the Supreme Court of Azerbaijan acts as the cassation instance.
What does it cost to pursue a claim in Azerbaijan?
Civil claims concerning property attract a state duty calculated as a percentage of the value of the claim on a sliding scale, subject to statutory minimum and maximum amounts, with an official calculator at e-mehkeme.gov.az. Lawyers’ fees are not fixed by any tariff and are agreed freely between lawyer and client. State-funded legal aid exists for those who qualify.
Is legal aid available if I cannot afford an advocate?
Free state-funded legal aid is provided through the Legal Aid Centre operated by the Azerbaijani Bar Association, for persons entitled to such assistance under the Law ‘On Lawyers and Lawyers’ Activity’. Eligibility depends on the criteria set out in that law, so it is worth asking the Centre directly about your situation.
