How it works

Finding the right lawyer for an injury claim in Spain

If you have been injured in Spain — on the road, at work, in a shop, a hotel or a public space — the first practical step is finding the right professional, because the Spanish system works differently from common-law countries such as the United Kingdom or Ireland. This page sets out how the courts, the profession, court costs and legal aid are organised under official Spanish and EU sources, and how our matching service fits in. You describe what happened in a short form; we compare your answers with lawyers who handle personal injury work in Spain, speak your language and appear before the courts your case may reach. The match is free. A personal injury lawyer in Spain then reviews the facts, explains your options and tells you which evidence to gather.

Spain in practice

How injury claims sit inside the Spanish legal system

Spain follows the continental civil-law model, based on comprehensive codes rather than judicial precedent, so procedure and the role of the courts differ from what you may know at home. The points below are drawn from official Spanish and European sources and explain who may represent you, where cases are heard, and what costs and legal aid look like.

A single profession, a single Bar

Membership of a Bar Association (Colegio de la Abogacía) is compulsory to practise law in Spain, and registration with one Colegio is enough to act throughout the country. Entry requires a law degree, the Máster de Acceso a la Abogacía or an equivalent course of 90 ECTS including professional practice, and the state aptitude examination under Law 34/2006. The CGAE coordinates the profession.

Lawyer and procurador

In civil litigation, the intervention of both an abogado (lawyer) and a procurador (procedural representative) is generally mandatory in Spain, except in small-claims cases (juicio verbal up to €2,000), where a party may appear in person. In criminal proceedings the defendant must be assisted by a lawyer, and legal assistance is constitutionally guaranteed.

Where cases are heard

At first instance, civil cases go to the Juzgados de Primera Instancia and criminal cases to the Investigating Courts and Criminal Courts. Appeals (apelación) are heard by the Audiencias Provinciales, with the High Courts of Justice operating at the level of each Autonomous Community. Cassation and review belong to the Tribunal Supremo in Madrid.

Court fees and lawyers’ fees

A court fee (tasa judicial) applies in the civil and contentious-administrative orders, but it is owed only by legal persons; natural persons are exempt under Law 10/2012. The criminal and labour orders carry no such fee. Lawyers’ fees are freely agreed between lawyer and client, with Bar associations publishing only non-binding guideline criteria.

Costs awards and free legal aid

The losing party may be ordered to pay the other side’s costs, capped at one third of the amount in dispute for lawyers’ and procuradores’ fees in declaratory proceedings. Free legal aid under Law 1/1996 provides a lawyer, a procurador and experts where household income falls below a threshold linked to the IPREM indicator, generally twice it and higher with dependants. Applications are filed with the Bar Association of the competent court.

Regional rules and language

Spain is highly decentralised: Catalonia, the Basque Country, Navarre, Galicia and the Balearic Islands have their own civil-law rules coexisting with the common Civil Code, so the applicable rule can depend on where you are. Spanish is the language of the courts, and lawyers must know Spanish and, where applicable, co-official regional languages.

Country data comes from official sources — the European e-Justice Portal, the Spanish Official State Gazette (BOE) and the Consejo General de la Abogacía Española — consulted in 2025.

Why people hesitate

What makes an injury claim in Spain feel complicated

Most people who contact us are not looking for a fight. They want to know whether their case is worth pursuing, what it will cost and who will deal with the Spanish paperwork.

01

The other side contacts you first

Insurers and opposing parties often make the first move while you are still recovering. Anything you sign or say early can shape the case, so it helps to have a lawyer read the offer before you reply.

02

Distance and language

You may be back home, working in another language, and unsure which documents actually matter. A lawyer used to foreign clients can take over correspondence in Spanish and keep you updated in English.

03

Time limits and evidence

Medical reports, witness details and accident records are easiest to secure in the first weeks. Spanish law sets different periods for different types of claim, so postponing the decision narrows your options.

What you get

A matched lawyer, not a directory listing

We are not a law firm and we do not advise on your case. We connect you with Spanish lawyers who already handle the type of matter you describe.

Lawyers who handle injury work

We match you with lawyers whose practice includes personal injury matters in Spain, from road traffic accidents to accidents at work and claims against businesses or public bodies.

Clear about cost

Spanish lawyers’ fees are freely agreed, so you discuss the fee arrangement directly with the lawyer before instructing anyone. Using our matching service costs you nothing.

Communication in your language

Many of the lawyers we work with advise clients in English as well as Spanish, so you can follow the procedure, the medical evidence and any settlement discussions in words you understand.

One request, several options

You complete one short form instead of ringing ten offices. We compare your answers with the lawyers available for your matter and location, and you choose who to speak to.

Cross-border help

Accidents in Spain often involve clients from elsewhere in Europe

If you were visiting, working, driving or living in Spain when you were injured, you are not the first client with this profile. We can look for a lawyer who is comfortable working across borders and languages.

Questions

Frequently asked questions about injury claims in Spain

How do I find a personal injury lawyer in Spain?

Start by describing your accident in the form on this page: what happened, where and when, what treatment you have had, and whether an insurer or employer has already contacted you. We compare that with lawyers who handle personal injury work in Spain and speak your language, then put you in touch. The match is free, and you decide whether to instruct.

Do I need a procurador as well as a lawyer in Spain?

In civil litigation, Spanish procedure generally requires both an abogado and a procurador, the procedural representative who files documents and receives notifications for you. The exception is small claims in the juicio verbal up to €2,000, where a party may appear in person. The lawyer you instruct will explain what your particular case requires.

Can I bring a claim if I live outside Spain?

Living abroad does not by itself prevent you from asking a Spanish lawyer to review your case, and many claims involve people who were visiting, working or driving in Spain when the accident happened. How your situation is treated depends on the facts, so the lawyer will assess it with you. We look for someone used to cross-border matters.

What do lawyers and courts cost in Spain?

Lawyers’ fees in Spain are freely agreed between lawyer and client; there are no binding official tariffs, although Bar associations publish non-binding guideline criteria. On court fees, a tasa judicial applies in the civil and contentious-administrative orders, but only legal persons owe it — natural persons are exempt. Criminal and labour proceedings carry no such fee.

Is free legal aid available for an injury claim in Spain?

Free legal aid (asistencia jurídica gratuita) is regulated by Law 1/1996 and can cover a lawyer, a procurador, experts and procedural costs where the household lacks sufficient means. The income threshold is linked to the IPREM indicator — generally twice it for a family unit, and higher where there are dependants. Applications are filed with the Bar Association of the competent court.

Are there time limits for claiming in Spain?

Yes, and they vary according to the type of claim, so acting early matters. Official sources list, for example, a five-year period for general contractual claims and one month for an administrative appeal. Whether a particular period applies to your injury claim, and when it starts to run, is a question your lawyer answers after reviewing the facts.
