Sick leave disputes in Belgium: what a lawyer actually does

Being off sick is a legal situation, not only a medical one. In Belgium, illness at work can touch on your employment contract, your pay, your duties towards your employer and your risk of dismissal, and each of those questions follows its own procedure. A sick leave lawyer in Belgium reads your file, checks the steps already taken, and tells you which tribunal is competent and what evidence you need. Because the courts are organised federally while language and parts of social law depend on where you live, the right adviser is the one who works in your region and your working language. Tell us what happened; our free matching service puts you in touch with a lawyer who handles these cases.

Belgium in practice

How Belgian courts, languages and costs shape an absence case

Before you speak to a lawyer it helps to know how Belgium organises employment cases: which tribunal hears them, which language applies, which bar the lawyer belongs to and how fees are recovered. The points below set out the framework that applies on Belgian territory.

Which court hears an employment dispute

Belgium’s ordinary judiciary is divided into 12 judicial districts, and each one has a labour tribunal (tribunal du travail / arbeidsrechtbank) sitting alongside the court of first instance. Employment and wage claims are brought there, and the time limit for such claims is one year. Appeals against a first-instance judgment must be lodged within one month.

The language of the case is fixed by territory

The language of judicial proceedings is fixed by the Law of 15 June 1935 and follows the territory: Dutch in the Flemish districts, French in the Walloon districts and German in the judicial district of Eupen. In the Brussels-Capital district the introductory document is drawn up in French or Dutch according to the defendant’s domicile, and the case is heard before the corresponding language section of the court.

Two national bars, one profession

Registration with a bar is compulsory in order to practise. Belgium has two national bars divided on linguistic lines: the Ordre des barreaux francophones et germanophone, which operates as AVOCATS.BE for the French-speaking and German-speaking bars, and the Orde van Vlaamse Balies for the Dutch-speaking bars. Training and the applicable deontological code therefore differ by community, with CAPA on one side and BUBA on the other.

Recovering costs: the procedural indemnity

Belgium has no general court tax. Costs consist mainly of modest registration fees in the labour and enterprise tribunals, bailiff fees for serving documents, and the procedural indemnity (indemnité de procédure / rechtsplegingsvergoeding). Since 21 April 2007 the losing party pays that fixed sum, set by Royal Decree of 26 October 2007, instead of the winner’s actual fees, so a successful party still bears part of its own costs.

Legal aid in two lines

Legal aid works in two lines. First-line aid is a free initial consultation available to everyone, without any income condition, through the legal aid commissions. Second-line aid assigns a lawyer to your case and is free or partly free depending on means: as indexed in September 2024, a single person with net monthly income below €1,582 qualifies for fully free aid, and a household below €1,884.

Federal courts, regional rules

The organisation of the courts is a solely federal competence, but many rules that shape everyday working life, such as housing, environment and planning, and parts of social and education law, are made by the three Communities and the three Regions. The rules can therefore differ depending on where your workplace and your home are. A lawyer working in your part of the country knows which layer applies.

Key time limit — Employment Law

Employment / wage claims — 1 year. Directly relevant if your absence dispute also involves unpaid wages or a similar employment claim.

Common situations

Why an absence at work becomes complicated

Most people do not arrive here because they want to litigate. They arrive because a letter, a payroll decision or a dismissal has made the situation unclear.

01

You do not know which court is competent

An absence from work can raise questions about pay, records or dismissal, and each route has its own forum in Belgium. Choosing the wrong one costs time you may not have.

02

The case runs in a language that is not yours

Proceedings follow the language of the judicial district, and the Brussels-Capital district works in two. A file opened in the wrong section has to be corrected.

03

Costs are hard to predict

Lawyers set their fees freely in Belgium and the losing party reimburses only a fixed procedural indemnity, not the full bill. Budgeting without advice is risky.

How we help

What you get from our free matching service

We do not give legal advice. We listen to your situation and introduce you to a practice that deals with this kind of file.

A specialised employment practice

We match you with a lawyer whose work covers employment and sickness at work, so you do not have to explain your sector from the very beginning of the conversation.

The right language and district

Because proceedings follow the language of the judicial district, your lawyer works in Dutch, French or German as required, or in the correct language section in Brussels.

Costs discussed up front

Your lawyer explains how fees are agreed, what the procedural indemnity may cover, and whether you fall within the income thresholds for free or partly free legal aid.

One request, several answers

You describe the situation once and practices that handle this type of sick leave dispute reply, with an average first response time of 24 to 48 hours.

Frequently asked

Questions about sick leave and lawyers in Belgium

What does a sick leave lawyer in Belgium actually do?

A sick leave lawyer in Belgium looks at your file as a legal problem rather than a medical one: the terms of your employment contract, the correspondence with your employer, any decision taken against you and the evidence that supports your position. The lawyer also identifies which tribunal is competent, in which language, and what the relevant time limits are.

Which court deals with an absence dispute in Belgium?

Employment and wage claims are brought before the labour tribunal (tribunal du travail / arbeidsrechtbank), which exists in each of Belgium’s 12 judicial districts alongside the court of first instance. These claims carry a one-year time limit, and an appeal against a first-instance judgment must be lodged within one month.

In which language will my case be heard?

The language follows the territory under the Law of 15 June 1935: Dutch in the Flemish districts, French in the Walloon districts and German in the judicial district of Eupen. In Brussels-Capital the introductory document is drawn up in French or Dutch according to the defendant’s domicile, and the case goes to the matching language section.

What will a lawyer cost, and can I get legal aid?

Fees are freely agreed between lawyer and client, so ask for the arrangement in writing. Belgium also runs two lines of legal aid: a free first-line consultation open to everyone, and second-line aid which is free or partly free below income thresholds indexed in September 2024 at €1,582 for a single person and €1,884 for a household.

Can I be represented without attending in person?

Representation by a lawyer is in principle required before the courts of first instance, the courts of appeal and the Court of Cassation. Parties may appear in person before the justice of the peace, before the labour tribunals in some first-instance cases, and in small claims matters. Your lawyer will confirm what applies to your file.

Do I have time to think about it?

Some deadlines are long and some are not. General contractual and personal claims have a ten-year period, tort claims and contract-nullity actions five years, while employment and wage claims must be brought within one year and an appeal within one month. Treat any letter with a date on it as urgent and have it checked.
