Finding the right adviser for a corporate tax question in Bosnia and Herzegovina
If your company is weighing a tax question in Bosnia and Herzegovina, the first practical step is finding a corporate tax lawyer in Bosnia and Herzegovina who can place the matter in the correct legal order. The country is not one jurisdiction but several: the State, the Federation of BiH and its ten cantons, the Republika Srpska and the self-governing Brčko District each enact and apply their own rules, and the applicable law can depend on where the case is connected. Add the constitutional priority of the European Convention on Human Rights and three official court languages, and the value of local professional judgement becomes clear. We do not give legal advice and we do not promise outcomes. We listen to your situation and match you, free of charge, with a lawyer whose practice covers corporate tax work in the relevant entity or district.
Local framework
How corporate matters sit inside Bosnia and Herzegovina’s multi-level legal order
Bosnia and Herzegovina is built from several legal orders that operate in parallel, so the same commercial question can be governed by different statutes depending on the territory. Understanding that structure is the starting point for any corporate tax file, and it shapes which lawyer you need.
No single body of private law
The Constitution of Bosnia and Herzegovina (Annex 4 of the Dayton Peace Agreement) divides the territory into the State, the Federation of BiH — itself made up of ten cantons — the Republika Srpska and the self-governing Brčko District. Each level legislates for itself on matters such as obligations, family law, succession, notaries, labour and real property, so the applicable entity or district law must be established before a corporate file can be assessed.
Who is entitled to practise
Admission to a bar association is compulsory in order to practise law. An attorney is entered in the directory of the regional bar association covering the seat of their office and thereby becomes a member of the entity-level bar association, whether that is the Bar Association of the Federation of BiH, of the Republika Srpska or of the Brčko District. Only attorneys entered in those registers may provide representation in court proceedings.
Representation before the courts
There is no unified judiciary: four court systems operate in parallel. In the Federation of BiH, municipal courts sit at first instance with cantonal courts on appeal and the Supreme Court in Sarajevo at the top. In the Republika Srpska, basic and district courts lead to the Supreme Court in Banja Luka. The Brčko District has its own Basic and Appellate Court, and the Court of Bosnia and Herzegovina hears the matters State law assigns to it.
Costs of proceedings
Court fees are set by separately enacted laws at each level. Before the Court of Bosnia and Herzegovina the fee on a statement of claim follows the value in dispute: 5% on the first 1,000 KM, 4% up to 5,000 KM and 3% above that, capped at 10,000 KM; an administrative-dispute action carries a fixed 100 KM fee and a judgment 200 KM. Lawyers’ fees follow the bar-association tariffs, and the losing party may be ordered to reimburse the winner’s costs.
Notarial form for property transactions
The notary is a public official central to formal transactions. Under the Law on Notaries of the Federation of BiH, transfers and encumbrances of immovable property, and other acts requiring solemn form, must be executed as a notarial deed; the notary verifies identity and capacity, controls legality and gives the act public force. A notarial deed is also a precondition for registration in the land register, and equivalent rules apply in the Republika Srpska and the Brčko District.
Rights that apply directly
Under Article II of the Constitution of Bosnia and Herzegovina, the European Convention on Human Rights and its Protocols apply directly in the country and have priority over all other law. Parties can therefore invoke Convention rights, including the right to a fair trial, before the domestic courts and the Constitutional Court. Proceedings and official documents may be conducted in Bosnian, Croatian or Serbian.

Common problems
Why corporate questions in Bosnia and Herzegovina are rarely straightforward
The complexity is structural, not accidental, and it starts with the question of which rules apply at all.
Which rules apply?
The State, the Federation of BiH and its cantons, the Republika Srpska and the Brčko District each legislate separately. The first question in any corporate file is therefore which level and which territory your company’s matter is actually connected to.
Finding a lawyer for the right level
Attorneys are admitted through regional and entity bar associations and work before different courts. A general commercial adviser may not be the right fit for a cross-entity corporate question, and the wrong pairing costs time.
Costs and deadlines you cannot guess
Court fees follow separately enacted laws, lawyers’ fees follow the bar-association tariffs, and even the general limitation period for contractual claims differs between entities. Guessing is expensive.
How we help
A matching service built around one country and one field
We do not publish legal advice. We identify the right adviser for your situation and put you in contact, free of charge.
Vetted specialists
We match you only with lawyers whose practice covers corporate work and who are registered with the competent bar association for the territory your matter concerns, whether that is the Federation of BiH, the Republika Srpska or the Brčko District.
Cross-entity reach
Because the country is composed of several legal orders, we look for advisers who work comfortably across entity lines and can tell you quickly which statute and which court are relevant to your file.
A clear first conversation
You explain the situation in plain terms, and the lawyer tells you what can realistically be done and on what basis. No promises, no pressure, and no obligation to go further.
No cost to be matched
Matching is free on our side. Fees for any work are agreed directly with the lawyer under the applicable bar-association tariff or a written agreement, and you decide whether to proceed.

Questions and answers
What clients ask before instructing a corporate tax lawyer in Bosnia and Herzegovina
What does a corporate tax lawyer in Bosnia and Herzegovina actually do?
The work starts with placing the question in the correct legal order, since the State, the Federation of BiH, the Republika Srpska and the Brčko District each legislate separately. From there, the lawyer prepares the submissions a procedure requires and represents the company before the competent courts and administrative bodies, where appearance by an admitted attorney is required in contentious proceedings.
Why does the entity or district matter so much?
Because core private law is enacted separately at each level. The clearest example is limitation: the general period for contractual claims is five years in the Federation of BiH and ten years in the Republika Srpska. Commercial claims for the sale of goods and services between legal entities are subject to a three-year period. The applicable law must be established before anything else.
Do I need a lawyer admitted in a specific entity?
Yes. Admission to a bar association is compulsory in order to practise, and an attorney is entered in the directory of the regional bar association covering the seat of their office, becoming a member of the entity-level bar association. Only attorneys entered in those registers may provide representation in court proceedings, so the pairing must match the territory.
Which courts could hear a corporate dispute in Bosnia and Herzegovina?
There is no unified judiciary. In the Federation of BiH, municipal courts sit at first instance, cantonal courts hear appeals and the Supreme Court sits in Sarajevo. In the Republika Srpska, basic and district courts lead to the Supreme Court in Banja Luka, with district commercial courts and a high commercial court for commercial matters. The Brčko District has its own courts.
What will it cost to bring a corporate claim?
Court fees are set by separately enacted laws. Before the Court of Bosnia and Herzegovina, the fee on a statement of claim follows the value in dispute: 5% on the first 1,000 KM, 4% up to 5,000 KM and 3% above that, capped at 10,000 KM. Lawyers’ fees follow the bar-association tariffs, and the losing party may be ordered to reimburse the winner’s costs.
Can a company obtain free legal aid?
Free legal aid before State institutions and the Court of Bosnia and Herzegovina is regulated by the Law on Free Legal Aid and administered through the Office for Free Legal Aid of the Ministry of Justice; it covers information, advice, drafting of submissions and representation. Eligibility is based on status or on a financial assessment, and entity-level institutions provide aid separately.
