Why businesses look for corporate tax counsel in Hungary

Running a company in Hungary means working inside a dense, codified legal environment, and tax questions rarely stay inside the tax file. A corporate tax lawyer in Hungary works where company law, reporting duties and administrative procedure meet: reviewing structures, handling correspondence with the authorities and, when a disagreement escalates, acting for your business before the administrative and labour courts and, above them, the regional courts. Hungary’s four-tier judiciary is headed by the Curia in Budapest, and only attorneys-at-law, law offices and registered in-house legal counsels may act as agents in an action, so the choice of counsel matters early. Describe your situation here and our matching service puts you in contact with a lawyer who already handles corporate tax work in Hungary — at no cost to you.

Hungary in practice

How corporate tax work is handled in Hungary

Corporate tax questions in Hungary are decided by written codes and by the courts that apply them, so the practical path runs through the Civil Code, the bar rules and a four-tier judiciary. These are the features that shape how a Hungarian matter is prepared and argued.

Practising law in Hungary

Only an attorney-at-law who belongs to one of Hungary’s regional bar associations may practise, and those chambers are themselves members of the Hungarian Bar Association (MÜK) in Budapest. Admission allows practice throughout the whole territory of Hungary, and Act LXXVIII of 2017 requires continuing professional training together with professional guarantee and indemnity insurance.

Company law inside the Civil Code

Commercial questions sit within Hungary’s comprehensive Civil Code (Act V of 2013), the Polgári Törvénykönyv, in force since 15 March 2014, which unified the rules on persons, property, obligations, companies and succession in eight Books. Where a corporate decision is contested, an action to set aside a company resolution must be brought within 30 days, with a one-year preclusion period.

The courts and the Curia

Hungary’s judiciary consists of 158 courts in four tiers: district courts, administrative and labour courts, regional courts and regional courts of appeal, with the Curia in Budapest at the top. There is no subordination between the levels, so higher courts cannot instruct lower ones, but the Curia’s uniformity decisions bind every court.

Who may represent your company

Representation by an attorney-at-law is mandatory in litigation unless an Act provides otherwise, yet it is not required in actions within the subject-matter jurisdiction of the district courts, including appeals and retrial. Before the regional court and the higher courts an attorney-at-law is required, and only attorneys-at-law, law offices and registered in-house legal counsels may act as agents.

Fees you should expect

Legal fees are freely agreed between lawyer and client by mandate; there is no binding statutory tariff for attorneys-at-law, and fee agreements fall under Act LXXVIII of 2017. Court fees are set by Act XCIII of 1990 and were reorganised on 28 January 2025, when first-instance contentious proceedings moved from a flat rate to a tiered scale based on claim value.

Where cost support exists

Legal aid under Act LXXX of 2003 covers advice, the drafting of documents and representation in civil, labour and administrative matters for persons lacking sufficient means, together with exemption from or deferral of procedural costs. Eligibility turns on the social reference base, which is set each year in the central budget act, so the thresholds move rather than being fixed amounts.

Common problems

What businesses run into

Three situations our visitors describe most often when they start looking for counsel in Hungary.

01

Deadlines that do not wait

An administrative appeal runs on a 15-day clock, and a challenge to a company resolution must be filed within 30 days with a one-year preclusion. Once such a window closes, the available options narrow sharply.

02

Rules written in codes

Hungary follows the continental civil law model based on written codes rather than judicial precedent. Arguments are built on the Civil Code and the relevant Acts, which changes how a file has to be assembled from the very beginning.

03

Finding the right specialist

Tax work touches company law, reporting duties and administrative procedure at once. A general practitioner may manage the paperwork, but a dispute before the administrative courts, or above them the regional court, calls for counsel used to that forum.

Questions

Corporate tax and Hungarian procedure: common questions

Do I need a corporate tax lawyer in Hungary, or can my accountant handle it?

Accountants and tax advisers manage filings and day-to-day compliance, but they are not attorneys-at-law and cannot act as agents in an action before the Hungarian courts. Where a matter turns into a dispute, or where you need a legal opinion on exposure, a corporate tax lawyer in Hungary is the professional who can represent your company.

Who is allowed to represent my company before a Hungarian court?

Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents. Representation by an attorney-at-law is mandatory before the regional court and the higher courts, while before a district court parties may act in person, including in appeals and retrial procedures.

Which courts would deal with a tax-related dispute in Hungary?

Hungary’s judiciary has 158 courts in four tiers: district courts, administrative and labour courts, regional courts and regional courts of appeal, headed by the Curia in Budapest. Administrative matters begin before the administrative and labour courts. The Curia’s uniformity decisions bind all courts, so its case law carries weight.

How much does it cost to instruct a Hungarian lawyer?

Legal fees are freely agreed between lawyer and client by mandate; there is no binding statutory tariff for attorneys-at-law. Court fees are separate and set by Act XCIII of 1990, which from 28 January 2025 applies a tiered scale to first-instance contentious proceedings. Ask for a written fee agreement before work starts.

Is there state support for legal costs in Hungary?

Yes. Under Act LXXX of 2003, legal aid covers advice, the drafting of documents and representation in civil, labour and administrative matters for persons lacking sufficient means, alongside exemption from or deferral of procedural costs. Eligibility is assessed against the social reference base, which is set each year in the central budget act.

How quickly will I hear back from the matching service?

We aim for a first response within 24 to 48 hours of receiving your request. There is no charge for the match, and you decide whether to go on and instruct one of the lawyers presented to you.
