The starting point

One country, several legal orders

Bosnia and Herzegovina does not administer permits or regulatory approvals through a single, uniform system. The Constitution divides legislative and executive power between the State, the Federation of BiH with its ten cantons, the Republika Srpska and the self-governing Brčko District, so the law that governs your application, the authority that decides it and the court that reviews it all depend on the activity and the territory concerned. A licensing lawyer in Bosnia and Herzegovina works through that structure daily: assembling the file, meeting formal requirements, answering requests for supplementation and, where necessary, bringing an administrative dispute. Describe your situation once, free of charge, and we match you with an admitted attorney whose practice covers your sector and the level of government involved.

Local framework

How licensing and regulatory matters work in Bosnia and Herzegovina

The rules that apply to your authorisation depend on the level of government that regulates the activity and on the entity or district in which you operate. The points below set out the structure, the professional requirements and the costs you should expect when you instruct a lawyer here.

Four court systems, four levels of regulation

There is no unified judiciary. The Court of Bosnia and Herzegovina in Sarajevo deals with State-level matters; Municipal Courts, Cantonal Courts and the Supreme Court of the FBiH serve the Federation; Basic and District Courts, District Commercial Courts, the High Commercial Court and the Supreme Court serve the Republika Srpska; and the Brčko District has its own Basic and Appellate Court. Review of a decision follows the system of the body that issued it.

Who may represent you

Admission to a bar association is compulsory in order to practise law. An attorney is entered in the directory of the regional bar association covering the seat of their office and thereby becomes a member of the entity Bar Association — the Bar Association of the Federation of BiH, the Bar Association of the Republika Srpska or the Bar Association of the Brčko District. Representation in contentious proceedings is normally reserved to admitted attorneys, and extraordinary remedies before the supreme courts require an attorney.

Entity divergence in substantive law

Because core private law is enacted separately at entity level, materially identical situations can be governed by different rules depending on territory. The clearest example is the general limitation period for contractual claims: five years in the Federation of BiH and ten years in the Republika Srpska. Establishing which entity’s law applies is therefore the first step in any assessment, particularly for creditors operating across the country.

Premises, real property and the notary

Where an authorisation depends on business premises, note that transfers and encumbrances of immovable property must be executed as a notarial deed. The notary verifies identity and capacity, controls legality and gives the act public, executory force. The notarial deed is a precondition for registration in the land register, and signature formalities apply to real-estate contracts.

Court fees and the cost of proceedings

Before the Court of Bosnia and Herzegovina the fee for a statement of claim is calculated on the value in dispute: 5% on the first 1,000 KM, 4% up to 5,000 KM and 3% on the amount above 5,000 KM, capped at 10,000 KM. A lawsuit in an administrative dispute carries a fixed fee of 100 KM and a judgment 200 KM. Entity, cantonal and District courts apply their own court-fee laws.

Free legal aid and cost relief

Free legal aid before State institutions and the Court of Bosnia and Herzegovina is regulated by the Law on Free Legal Aid and covers legal information, advice, drafting of submissions and representation, including appeal drafting. Eligibility depends on status or on a poor financial situation. At entity and cantonal level, separate public institutions provide assistance, and courts may exempt a party from costs where payment would jeopardise subsistence.

Common difficulties

Why licensing matters get complicated here

Most delays are caused by structure and formality rather than by the merits of the application itself.

01

The competent level is not obvious

Your activity may be regulated by the State, an Entity, a canton or the Brčko District, each with its own legislature and executive. Filing with the wrong body costs months, and the time allowed for correcting a file is short.

02

Different rules in the same country

Limitation periods, procedural steps and court fees differ between the Federation of BiH, the Republika Srpska and the Brčko District. A generic answer prepared for one part of the country is rarely safe for another.

03

Formality is easy to underestimate

Notarial deeds, registration duties and formal requirements for property-related acts decide whether a file is complete. An incomplete submission, rather than a weak argument, is the most frequent reason for delay.

How we help

Matched to a lawyer who works with your level of government

We do not advise you ourselves. We identify the specialisation your matter needs and introduce you to an admitted attorney who handles it.

The right level first

We match you with a lawyer who routinely appears before the authority and the court dealing with your type of authorisation, so the file is started in the correct place from the outset.

Entity-aware assessment

Your adviser establishes which entity’s or district’s law applies before assessing your position, including limitation periods, procedural steps and the consequences of delay.

Representation and review

Only attorneys entered in a bar association register may represent parties in contentious proceedings, and extraordinary remedies before the supreme courts require an attorney. We match you with one who does this work.

Costs visible in advance

You receive information on the applicable court-fee rules and on the bar tariff used to assess attorney fees, together with how the costs of proceedings may be recovered if you succeed.

Cross-border

Licensing matters with a link to another country

Where your authorisation, premises, counterparty or parent company sits outside Bosnia and Herzegovina, the applicable entity law still has to be identified before anything is filed. We work with lawyers who handle matters connected to neighbouring and other European jurisdictions.

Questions

Frequently asked questions

Who may act as a licensing lawyer in Bosnia and Herzegovina?

Only lawyers admitted to a bar association may practise. Under the Law on the Legal Profession of the Federation of BiH, admission requires citizenship of Bosnia and Herzegovina, a completed law degree, a passed bar examination and a separate attorney examination, at least two years of legal work experience and suitable office premises. The Republika Srpska and the Brčko District apply equivalent regimes through their own registers.

Which authority will decide my application?

That depends on the level of government that regulates the activity concerned. Power is divided between the State, the Federation of BiH and its ten cantons, the Republika Srpska and the Brčko District, each with its own legislature, executive and judiciary. The lawyer you are matched with identifies the competent body, its procedure and the review route before any filing is made.

How long do I have to pay a court fee once the court orders it?

Before the Court of Bosnia and Herzegovina, a court fee ordered by the court must be paid within 15 days. The amount itself is calculated on the value in dispute under the State court-fee law, while the courts of the Federation, the Republika Srpska and the Brčko District apply their own separately enacted court-fee rules.

Do limitation periods really differ across the country?

Yes. The general limitation period for contractual claims is five years in the Federation of BiH and ten years in the Republika Srpska, under the respective entity laws on obligations. Commercial claims between legal entities follow a three-year period, claims for rent and other periodic payments including interest three years, and claims established by a final judgment or settlement ten years.

Can I obtain free legal aid for a regulatory dispute?

Free legal aid before State institutions and the Court of Bosnia and Herzegovina is regulated by the Law on Free Legal Aid and administered through the Office for Free Legal Aid of the Ministry of Justice. It covers legal information, advice, drafting of submissions and representation, including appeal drafting. Eligibility is based on status or on a poor financial situation assessed by the competent body.

In which language will my case be conducted?

Bosnian, Croatian and Serbian are the official languages, written in both Latin and Cyrillic script, and proceedings and official documents may be conducted in any of them. Separately, the European Convention on Human Rights and its Protocols apply directly in Bosnia and Herzegovina and take precedence over all other law, so Convention rights may be invoked before domestic courts.
