Why the entity and the court matter before anything else
If you are facing a theft allegation in Bosnia and Herzegovina, the first practical questions are where your case will run and who may stand beside you in court. There is no single judiciary here: the State, the Federation of BiH, the Republika Srpska and the Brčko District each operate their own courts, and the criminal procedure code that applies follows the territory. That is why a theft lawyer in Bosnia and Herzegovina cannot be chosen in the abstract — the bar association, the competent court and the applicable tariff depend on the place of the proceedings. Tell us briefly what you are facing. We match you, free of charge, with an attorney admitted to the relevant bar association who handles theft cases in your area, and you decide whether to instruct them.
Bosnia and Herzegovina in practice
How a theft case moves through the courts of Bosnia and Herzegovina
Bosnia and Herzegovina is a multi-layered legal order: the State, two Entities — the Federation of BiH, itself divided into ten cantons, and the Republika Srpska — and the self-governing Brčko District each have their own legislature, executive and judiciary. For a theft case this means the competent court, the applicable criminal procedure code and the bar association of your representative all follow the territory in which the proceedings are conducted. The notes below set out the framework and the verified time limits that apply in the country.
Four court systems, one set of facts
Bosnia and Herzegovina has no unified judiciary. The State, the Federation of BiH, the Republika Srpska and the Brčko District legislate and adjudicate separately, each with its own criminal procedure code. A theft case normally begins before a Municipal Court (Općinski sud) in the FBiH or a Basic Court (Osnovni sud) in the RS, with appeal to the Cantonal, District or Appellate court respectively. State-level offences fall to the Court of Bosnia and Herzegovina in Sarajevo.
Who may represent you in court
Admission to a bar association is compulsory in order to practise. An attorney is entered in the directory of the regional bar association covering the seat of their office; there is no direct admission to an umbrella association. Under the FBiH Law on the Legal Profession, admission requires BiH citizenship, a completed law degree, the bar examination, the attorney examination, at least two years of legal work experience and suitable office premises. The RS and Brčko District apply equivalent regimes under their own laws.
The right to a defence and mandatory defence
In criminal proceedings the accused has a right to legal representation. Mandatory defence — a court-appointed attorney — applies where the accused cannot afford counsel in cases carrying a prescribed sentence, or where the interests of justice so require, under the criminal procedure codes of the State and the Entities. Which code governs your file depends on the level and the territory in which the proceedings are conducted.
Fair-trial rights you can invoke directly
Article II of the Constitution of Bosnia and Herzegovina makes the European Convention on Human Rights and its Protocols directly applicable, with priority over all other law. In a theft prosecution this means the Article 6 right to a fair trial can be relied on before the domestic courts and, ultimately, before the Constitutional Court of Bosnia and Herzegovina.
Language of the proceedings and of documents
Bosnian, Croatian and Serbian — mutually intelligible standard varieties written in both Latin and Cyrillic script — are the official languages, and proceedings and official documents may be conducted in any of them. This shapes how statements, filings and service of documents are drafted, and it matters where the accused person lives or works abroad.
Free legal aid and who can apply
Free legal aid before State institutions and the Court of Bosnia and Herzegovina is regulated by the Law on Free Legal Aid and administered through the Office for Free Legal Aid of the Ministry of Justice; it covers information, advice, drafting of submissions and representation, including appeal drafting. Eligibility is based on status — for example recipients of social assistance, children, pensioners below the average pension or unemployed persons without other income — or on a poor financial situation. Entity and cantonal institutions provide aid separately.

Common concerns
What people facing theft charges in Bosnia and Herzegovina ask us first
Three practical worries come up again and again, and each of them has an answer that depends on the territory and the stage of the file.
I do not know which court has jurisdiction
Bosnia and Herzegovina runs four parallel court systems, so the same facts can be heard before a Municipal Court in the Federation of BiH, a Basic Court in the Republika Srpska or a court in the Brčko District. Identifying the competent court comes first.
I cannot tell whether I qualify for free legal aid
Eligibility may rest on status — social assistance, children, pensioners below the average pension, unemployed persons without other income — or on a poor financial situation assessed by the competent body. Which provider applies also depends on the level of the case.
I do not know what a defence will cost
Each entity’s bar association adopts an official tariff setting minimum or guideline rates, and no binding State-wide tariff applies. You remain free to agree a fee in writing, so the cost picture becomes clearer once your representative and your court are known.
How we help
Matching you with the right defence lawyer for your file
We are not a law firm and we do not give legal advice. We take your description of the case and connect you with attorneys whose registration, area and language fit it.
Match by entity and court
We look for an attorney admitted to the bar association covering the area where your proceedings run — the FBiH, the RS or the Brčko District — so that representation requirements are met from the outset.
Criminal defence focus
You are matched with lawyers who handle criminal defence work, including cases where a right to representation and mandatory defence provisions apply under the State and Entity criminal procedure codes.
Language you can work in
Proceedings may be conducted in Bosnian, Croatian or Serbian, and you can tell us which language, or which additional language, you need for meetings, documents and correspondence with your representative.
A clear cost conversation
Your matched attorney can explain the entity tariff that applies and agree a written fee arrangement with you, so that fees are discussed openly before you decide whether to instruct.
Cross-border
Beyond Bosnia and Herzegovina
If your situation, your business or your family connections extend past the borders of Bosnia and Herzegovina, we also match clients with lawyers in neighbouring and other European jurisdictions.
Questions
Theft cases in Bosnia and Herzegovina: frequently asked questions
How do I find a theft lawyer in Bosnia and Herzegovina?
Describe your situation in a few lines: what you are accused of, where the case is running and how far it has progressed. We then match you, free of charge, with a theft lawyer in Bosnia and Herzegovina who is admitted to the bar association covering that area and handles criminal defence. You decide whether to instruct them.
Which court will hear a theft case in Bosnia and Herzegovina?
That depends on the territory. In the Federation of BiH, first-instance jurisdiction lies with the Municipal Courts, with Cantonal Courts as appellate courts; in the Republika Srpska, Basic Courts and District Courts sit at first instance; the Brčko District has its own Basic Court and Appellate Court. State-level offences fall to the Court of Bosnia and Herzegovina in Sarajevo.
Must my representative be a member of a bar association?
Yes. Only attorneys entered in the registers of the Bar Association of the Federation of BiH, the Bar Association of the Republika Srpska or the Bar Association of the Brčko District may provide representation in court proceedings. In the FBiH, admission requires BiH citizenship, a law degree, the bar examination, the attorney examination, at least two years of legal work experience and suitable office premises.
What happens if I cannot afford a defence lawyer?
In criminal proceedings the accused has a right to legal representation, and mandatory defence — a court-appointed attorney — applies where the accused cannot afford counsel in cases carrying a prescribed sentence or where the interests of justice so require. Free legal aid before State institutions and the Court of BiH is also available through the Office for Free Legal Aid, subject to status or financial criteria.
How are a defence lawyer’s fees calculated in Bosnia and Herzegovina?
Each entity’s bar association adopts an official tariff (Advokatska tarifa) that sets minimum or guideline rates, and no binding State-wide tariff applies. You remain free to agree a fee in writing with your attorney. Where a court orders the losing party to reimburse the prevailing party’s costs, attorney fees are assessed in accordance with the applicable tariff.
Can I rely on the European Convention on Human Rights in criminal proceedings?
Yes. Under Article II of the Constitution of Bosnia and Herzegovina, the European Convention on Human Rights and its Protocols apply directly and take priority over all other law. The Article 6 right to a fair trial can therefore be invoked before the domestic courts and, ultimately, before the Constitutional Court of Bosnia and Herzegovina.
