Your situation

Consumer disputes in Hungary, explained simply

A defective product, a cancelled service, an unfair contract term or a trader who simply stops answering — consumer problems in Hungary often stay unresolved because it is hard to know which route leads to a real remedy. Hungarian private law is codified in the Civil Code (Act V of 2013), which has governed contracts and obligations since 15 March 2014, and the courts apply written rules rather than binding precedent. Whether your dispute concerns a cross-border purchase, a warranty claim or an unfair term, we match you with a consumer rights lawyer in Hungary who deals with these rules regularly. You describe the situation, we compare specialised attorneys, and you decide who to instruct. The matching service costs you nothing.

Hungary in practice

How consumer and contract disputes work in Hungary

Hungary follows the continental civil-law model: judges decide on the basis of written codes, and the Civil Code (Act V of 2013) has regulated contracts, defective performance and damages since 15 March 2014. Court structure, representation rules and fee scales all shape how a consumer claim actually proceeds.

A single codified framework for obligations

Since 15 March 2014, contracts, defective performance and damages in Hungary have been governed by the Civil Code (Act V of 2013), which replaced the 1959 code and unified the rules on persons, property, obligations and succession in eight Books. Because Hungarian private law follows the continental model, judges rely on the written code rather than earlier judgments as their primary source.

Which court hears your dispute

The Hungarian judiciary comprises 158 courts in four tiers: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék) and regional courts of appeal, headed by the Curia (Kúria) in Budapest. There is no subordination between the levels and higher courts cannot instruct lower ones. The Curia issues uniformity decisions that bind all courts, keeping the reading of the Civil Code consistent.

Representation before the courts

Under the Civil Procedure Code (Act CXXX of 2016), legal representation is mandatory in litigation as a general rule, but it is not required in actions falling within the subject-matter jurisdiction of the district courts, including appeals and retrial procedures. Only attorneys-at-law, law offices and registered in-house legal counsel may act as agents, so assistance becomes essential before the regional court and the higher courts.

Who may practise as an attorney

Practising law requires membership of one of the regional bar associations, which are themselves members of the Hungarian Bar Association (Magyar Ügyvédi Kamara) seated in Budapest. Act LXXVIII of 2017 regulates the profession, including mandatory continuing training and a professional guarantee and indemnity scheme. An admitted attorney may practise throughout the whole territory of Hungary, and roughly 15,000 attorneys-at-law are registered.

Court fees after the 2025 reform

For first-instance contentious civil proceedings, the court fee is calculated on a tiered scale under Act XCIII of 1990, following the reform of 28 January 2025. A claim of up to HUF 300,000 attracts HUF 18,000; larger claims add percentages step by step, up to HUF 8,289,500 plus 0.5% above HUF 500,000,000. Appeal and review proceedings attract separate fees.

Fees, legal aid and what you pay

Attorneys’ fees are freely agreed between lawyer and client by mandate; there is no binding statutory tariff, and fee agreements are governed by Act LXXVIII of 2017. Where means are limited, Act LXXX of 2003 on legal aid supports advice, document drafting and representation in civil, labour and administrative matters, together with exemption from or deferral of procedural costs where the statutory conditions are met.

Why consumers get stuck

The reasons a valid claim often goes nowhere

Understanding the obstacle is the first step towards resolving it.

01

You cannot tell which route applies

A faulty product, a misleading advertisement and an unfair contract term are handled differently, and the correct route depends on the facts. Without guidance, time and money are spent on the wrong procedure.

02

You do not know what it costs

Court fees follow a tiered scale, attorneys’ fees are freely agreed, and legal aid depends on a needs test. Uncertainty about cost stops many consumers from enforcing a legitimate claim.

03

The trader stops responding

Once correspondence breaks down, escalation normally requires formal steps. Knowing which one, and within what time limit, is where specialised representation makes the difference.

Common questions

Consumer rights in Hungary — FAQ

Do I need an attorney to bring a consumer claim in Hungary?

Legal representation is mandatory in litigation as a general rule, but under the Civil Procedure Code (Act CXXX of 2016) it is not required in actions falling within the subject-matter jurisdiction of the district courts, including appeals and retrial procedures. Only attorneys-at-law, law offices and registered in-house legal counsel may act as agents, and representation is required before the regional court and higher courts.

What does it cost to use your matching service?

Nothing. Describing your situation and receiving matched attorneys is free, and there is no obligation to instruct anyone. If you decide to work with an attorney, fees and mandate terms are agreed directly between the two of you.

How long do I have to pursue a consumer-related money claim in Hungary?

The Civil Code provides a general five-year limitation period for debt recovery, while other claims follow different rules — labour claims, for example, are subject to three years. Because the applicable period depends on how the claim is characterised, a consumer rights lawyer in Hungary should assess your facts and confirm the relevant deadline.

Can a consumer rights lawyer in Hungary help with a cross-border purchase?

Yes. Hungarian courts apply the codified Civil Code (Act V of 2013), and an attorney admitted to a regional bar association may practise throughout the whole territory of Hungary. We match clients with attorneys who handle cross-border consumer and contract matters and who can work in your language.

How are court fees calculated in a Hungarian civil case?

Following the reform of 28 January 2025, first-instance contentious proceedings attract a tiered court fee under Act XCIII of 1990: HUF 18,000 for claims up to HUF 300,000, with percentages added step by step for larger amounts. Appeals and review proceedings attract separate fees. Your attorney can calculate the figure for your case.

Is legal aid available for consumer disputes in Hungary?

Act LXXX of 2003 on legal aid provides support for advice, document drafting and representation in civil, labour and administrative matters. Eligibility depends on a needs assessment tied to the social reference base rather than a fixed forint amount in the Act, and the value of that base is set each year in the central budget act.
