Your situation

Why the choice of representative matters in Hungary

Copyright protects creative work such as text, music, film, software and photography, and disputes over it are decided by the civil courts of Hungary. If you own rights, license them, or stand accused of using protected material without permission, a copyright lawyer in Hungary helps you understand which court will hear the matter and what representation you need. Because Hungarian civil procedure requires an attorney-at-law before the regional courts and higher courts, choosing the right representative early shapes your whole case. Through our free service you describe your situation once, and we connect you with a Hungarian attorney-at-law whose practice covers intellectual property. There is no cost to be matched, no obligation to instruct, and no promise about how any dispute will end.

Hungary in practice

How civil claims and representation work in Hungary

Hungary is a continental jurisdiction built on written codes, with a four-tier court system headed by the Curia in Budapest. The rules below explain who may practise, where representation is compulsory, and how fees and deadlines are structured in Hungarian civil proceedings.

Codified private law and the courts

Copyright disputes are civil matters, and Hungary follows the continental model based on written codes rather than judicial precedent. The Civil Code (Act V of 2013) has been in force since 15 March 2014, replacing the 1959 code. Claims typically begin before the district courts (járásbíróság), while the regional courts (törvényszék) hear matters falling outside that jurisdiction.

Who may act as your representative

Practising as an attorney-at-law in Hungary requires membership of a regional bar association; the regional bars are members of the Hungarian Bar Association (Magyar Ügyvédi Kamara), seated in Budapest. Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents in an action, and an admitted attorney may practise anywhere in the country.

Where representation is compulsory

Legal representation is mandatory in litigation unless an Act provides otherwise, but it is not required in matters within the jurisdiction of the district courts (járásbíróság), including appeals and retrial procedures. In practice you may appear in person at district-court level, while an attorney-at-law is required before the regional court and the higher courts.

Court fees in civil proceedings

In contentious civil proceedings the court fee follows a tiered scale under Act XCIII of 1990, as reformed on 28 January 2025. A claim valued up to HUF 300,000 attracts a fee of HUF 18,000; between HUF 300,001 and HUF 3,000,000 the fee is HUF 18,000 plus 4.5% of the excess. Appeal and review proceedings carry separate fees.

Attorneys’ fees and legal aid

There is no binding statutory tariff for attorneys-at-law; fees are freely agreed by mandate, and the framework is set by Act LXXVIII of 2017, which also regulates the professional guarantee and indemnity insurance attorneys must maintain. Legal aid under Act LXXX of 2003 can cover legal services where your available monthly net income does not exceed the social reference base and you hold no assets.

Time limits that shape a claim

Time limits shape every civil dispute. The general limitation period for debt recovery is five years, a compulsory-share claim in succession lapses after five years, and a community action on personality rights must be brought within 30 days. Where a company resolution is challenged, the claim must be filed within 30 days, with a one-year preclusion period.

Common problems

What clients bring to us

Most people arrive with the same three uncertainties: which court, which documents, and which representative.

01

You are unsure which court level applies

Rights owners often do not know whether their matter belongs before a district court or a regional court, or whether an attorney-at-law must be instructed at all. Guessing wrong costs time and money.

02

A letter or notice has already arrived

A cease-and-desist letter, a takedown or a licensing disagreement can appear without warning. You need to know what the document demands and how Hungarian civil procedure expects a response.

03

The contracts were signed abroad

Licences, assignments and platform terms are frequently drafted in another language and signed in another country. Understanding how a Hungarian court would approach them is the first practical step.

Questions

Frequently asked questions

Do I need a copyright lawyer in Hungary, or can I represent myself?

In Hungarian civil litigation, legal representation is mandatory unless an Act provides otherwise, but it is not required in matters within the jurisdiction of the district courts (járásbíróság), including appeals and retrial procedures. Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents, so assistance is essential before the regional court and the higher courts.

Which courts hear civil disputes in Hungary?

Hungary has 158 courts arranged in four tiers: district courts, administrative and labour courts, regional courts, and regional courts of appeal, headed by the Curia (Kúria) in Budapest. Higher courts cannot issue instructions to lower ones and judges are independent, but uniformity decisions of the Curia bind all courts, which matters when a point of law is contested.

How are attorneys’ fees and court fees set in Hungary?

Attorneys’ fees are freely agreed between lawyer and client by mandate; there is no binding statutory tariff. Court fees in contentious civil proceedings follow a tiered scale under Act XCIII of 1990 as reformed on 28 January 2025: for example, a claim valued up to HUF 300,000 attracts a fee of HUF 18,000, and appeal and review proceedings carry separate fees.

Can I obtain legal aid for a civil dispute in Hungary?

Legal aid under Act LXXX of 2003 supports legal services in civil, labour and administrative matters for people without sufficient means. Eligibility turns on whether your available monthly net income exceeds the social reference base and whether you hold assets; certain groups are treated as needy regardless. The forint value of the reference base is set each year in the central budget act.

How does your free matching service work?

You describe your situation once, in your own words, and tell us what you need. We then match you with a Hungarian attorney-at-law whose practice covers intellectual property. Matching costs you nothing and does not oblige you to instruct anyone. You decide whether to proceed after you have spoken to the attorney.

I am based outside Hungary. Can a Hungarian attorney-at-law still help?

Yes. A person entitled to practise may carry out the professional activities of an attorney-at-law throughout the whole territory of Hungary, and Hungarian attorneys are admitted through the regional bar associations. Many handle cross-border licensing and enforcement work, and they can explain which court level your matter would reach and what representation is required.
