How we help

A damages claim in Hungary needs the right file, not the loudest advert

If you were injured in Hungary, the practical questions come quickly: who pays, what evidence survives, and how long you have. Hungarian civil liability is codified, so the wording of the Civil Code (Act V of 2013), in force since 15 March 2014, carries real weight in how a court assesses fault, causation and the amount of compensation. A personal injury lawyer in Hungary will read your medical records, police or accident reports and witness statements in Hungarian, map them onto the statutory conditions, and explain the realistic range of what can be claimed. Our service matches you with attorneys who already handle this type of work, free of charge and without obligation.

Hungary in practice

What makes a personal injury claim in Hungary different

Hungarian private law is codified rather than precedent-driven, and the court structure is strictly hierarchical in organisation but not in instruction. These two features shape how a damages file is prepared and where it is decided.

Damages sit inside a codified law of obligations

Hungary replaced its 1959 Civil Code with a comprehensive new code (Act V of 2013, Polgári Törvénykönyv) that entered into force on 15 March 2014. It unifies persons, family law, property, obligations and succession in one instrument of eight Books. Non-contractual damages claims arising from accidents are assessed against that written law rather than against previous judicial decisions.

Where the case is heard

The judiciary consists of 158 courts in a four-tier hierarchy: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék), regional courts of appeal (ítélőtábla) and the Curia (Kúria) in Budapest. Higher courts cannot instruct lower ones and judges are independent, yet the Curia issues decisions that bind all courts and keep the case law consistent.

Who may act for you

Practising as an attorney-at-law (ügyvéd) requires membership of a regional bar association; those associations are members of the Hungarian Bar Association (MÜK), seated in Budapest. Representation is mandatory in litigation as a general rule, but not in actions falling within the jurisdiction of the district courts, where you may appear in person. Before the regional court and above, an attorney is required.

Court fees and lawyers’ fees

Court fees (illeték) follow Act XCIII of 1990. Since 28 January 2025 first-instance contentious proceedings use a tiered scale instead of the former flat 6%: HUF 18,000 applies up to a claim value of HUF 300,000, with 4.5% to 7% of the excess added depending on the band. Lawyers’ fees are freely agreed by mandate; there is no binding statutory tariff.

Time limits and help with costs

Hungarian civil claims are subject to limitation, and the general limitation period recorded for monetary claims is five years. Because the period that applies depends on how your claim is classified, a Hungarian attorney should confirm the deadline for your file. Where means are limited, Act LXXX of 2003 on legal aid can support advice, document drafting and representation in civil matters.

The country data on this page is drawn from official Hungarian sources (the courts’ own portal and the Hungarian legal database) and from the legislation cited above; it is current as of the dates shown on those pages.

Common difficulties

What usually goes wrong before a lawyer is involved

Most files are lost or weakened in the first weeks, long before a hearing is scheduled.

01

Evidence disappears

Accident reports, CCTV footage, medical notes and witness details are easiest to secure in the days after the incident and much harder to reconstruct months later.

02

Nobody explains the deadline

Civil claims are subject to limitation, and the period that applies depends on how your claim is classified, so waiting for clarity can quietly cost you the case.

03

The system feels closed

Court documents, fee scales and procedural rules are in Hungarian, and representation requirements differ between the district court and the higher courts.

Frequently asked

Questions about personal injury claims in Hungary

How do I find a personal injury lawyer in Hungary?

You can search the register of the Hungarian Bar Association and its regional chambers, or use our free matching service. Tell us what happened, where it happened and what documents you hold, and we introduce attorneys whose practice includes non-contractual damages claims. You then decide whether to instruct one of them.

Is legal representation compulsory in a Hungarian personal injury case?

Not always. Under the Civil Procedure Code, representation by an attorney is mandatory in litigation as a general rule, but it is not required in actions within the subject-matter jurisdiction of the district courts (járásbíróság), where parties may appear in person. Before the regional court and higher courts an attorney is required, and only attorneys, law offices and registered in-house counsels may act as agents.

How much does it cost to bring a claim in Hungary?

Court fees are set by Act XCIII of 1990. Since 28 January 2025 first-instance contentious proceedings follow a tiered scale instead of the former flat 6%: HUF 18,000 up to a claim value of HUF 300,000, plus 4.5% to 7% of the excess depending on the band. Lawyers’ fees are freely agreed by mandate, with no binding statutory tariff.

What is the time limit for a personal injury claim in Hungary?

Hungarian civil claims are subject to limitation, and the general limitation period recorded for monetary claims is five years. The correct period depends on how the claim is classified, so a Hungarian attorney should confirm the deadline that applies to your file before anything else is done.

Can I get legal aid for a damages claim in Hungary?

Legal aid under Act LXXX of 2003 covers legal advice, the drafting of documents and representation in civil, labour and administrative matters for persons lacking sufficient means, and can include exemption from or deferral of procedural costs in certain cases. Eligibility is tied to the social reference base, whose forint value is set annually in the central budget act.

Which courts handle these cases in Hungary?

The judiciary has 158 courts in four tiers: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék), regional courts of appeal (ítélőtábla) and the Curia (Kúria) in Budapest. Judges are independent and higher courts cannot instruct lower ones, but Curia decisions bind all courts to keep practice consistent.
