What to do after an injury that was not your fault
An injury that was not your fault leaves you with medical bills, lost income and a file of documents you never expected to keep. Whether the harm happened on a road, at work, in a rented flat or during a medical procedure, the practical questions are the same: who is responsible, what evidence proves it, and what can realistically be recovered. We do not give legal advice. We listen to what happened and match you with a personal injury lawyer in Romania who handles this type of claim, explains the courts and costs involved, and tells you what to gather before the first meeting. Matching is free, there is no obligation, and you decide whether to go ahead once you have spoken to the lawyer.
Romania in practice
How injury claims work in the Romanian legal system
Romania is a continental civil-law jurisdiction: the codes set the rules, and judicial precedent is generally not a source of law. Procedure, costs and time limits are therefore found in legislation rather than in earlier decisions, which is why a local lawyer is essential from the first step.
The courts that hear injury claims
Romania follows the continental civil-law model, and court decisions are not as a rule a source of law. The ordinary courts sit in four tiers: the judecătorii (local district courts) hear most civil claims below statutory value thresholds, the tribunale hear larger first-instance cases, the 15 curţi de apel hear appeals, and the Înalta Curte de Casaţie şi Justiţie in Bucharest ensures uniform interpretation.
Who may act for you in court
Membership of a Romanian Bar is compulsory in order to practise law, and all bars are united in the National Association of Romanian Bars (UNBR). Admission is by examination organised through INPPA, followed by a compulsory traineeship before a lawyer becomes definitiv. Only lawyers registered with a Romanian Bar may appear before Romanian courts.
When the injury also amounts to an offence
Where the harm is also an offence, the file moves under the Criminal Code (Law No 286/2009) and the Criminal Procedure Code (Law No 135/2010). The right to legal assistance and to court-appointed counsel is guaranteed, and the accused must be assisted by a lawyer where the law makes defence mandatory. Ask at the first meeting how the criminal file affects your civil claim.
Limitation periods decide whether a claim survives
Romanian civil claims are time-barred if not brought within the applicable limitation period, and the general period for debt and contractual claims is three years. Because the period that governs depends on how a claim is framed, the first task is to date the event, confirm the rule that applies and secure medical records, photographs and witness details before they disappear.
Court fees, lawyers’ fees and who pays
Court actions carry a judicial stamp fee under Government Emergency Ordinance No 80/2013, calculated on a degressive sliding scale for money claims and payable in advance at first instance and on appeal. Lawyers’ fees are freely negotiated, as there is no binding official tariff. A losing party may be ordered to pay the winner’s costs, subject to the court’s assessment of reasonableness.
Legal aid for people of limited means
Free public legal aid in civil matters is governed by Government Emergency Ordinance No 51/2008. It is available where the average net monthly income per family member over the two months before the application is below 300 lei. The aid can cover lawyers’, experts’ and bailiffs’ fees and can exempt or reduce court fees, within an annual ceiling.

Common situations
What usually brings people to us
Injury files rarely start with a clear legal question. They start with a practical problem and a deadline nobody explained.
The other side already has representation
An insurer, an employer or a transport company has a legal team in place and has made a first offer. You are being asked to sign something you do not fully understand, and you want an independent view before you respond.
You cannot tell which court or rule applies
Romanian procedure allocates claims between district courts, tribunals, courts of appeal and the High Court. Without local knowledge it is hard to know where a file should be lodged or what has to be proved there.
Evidence is fading while you recover
Witnesses move on, CCTV is overwritten and medical notes are archived. The longer an injury file sits untouched, the more the practical proof of what happened depends on documents gathered early.
Why use the matching service
A short route to the right Romanian lawyer
We are a matching platform, not a law firm. Our role is to connect your situation with a lawyer who already works on this type of case.
Specialisation over geography
A lawyer who handles injury files knows the medical evidence, the procedural steps and the cost structure. We match on the nature of your harm and the forum where the claim belongs, not simply on the nearest office.
One conversation, clear next steps
You describe the event, the injuries and the correspondence you have received. The lawyer explains what a claim would involve under Romanian law, what documents are needed and what could reasonably be recovered.
Costs explained before you commit
Court fees follow a statutory scale and lawyers’ fees are freely negotiated, so the numbers vary. The lawyer sets out the fee arrangement and the expected disbursements before you decide whether to instruct anyone.
Cross-border files welcome
Injured while working, driving or travelling in Romania? Files with a foreign element are common, and proceedings in Romanian courts are conducted in Romanian, so a locally registered lawyer is the practical starting point.

Questions
Frequently asked questions
Do I need a personal injury lawyer in Romania if the insurer has already contacted me?
An insurer’s first offer is not an assessment of your legal position. A personal injury lawyer in Romania can review the medical evidence, explain how responsibility is established under Romanian civil law and set out what the offer actually covers. You are free to take advice before accepting anything, and matching through this site costs nothing.
How long do I have to start an injury claim in Romania?
Romanian civil claims are subject to limitation periods, and the general period for debt and contractual claims is three years. Injury claims can rest on different legal bases, so the applicable period has to be checked case by case. A lawyer will establish when time started to run and whether it was interrupted.
Can a lawyer qualified abroad represent me in a Romanian court?
No. Only lawyers registered with a Romanian Bar may practise before the Romanian courts, and bar membership is compulsory, with all bars united in the National Association of Romanian Bars (UNBR). A lawyer qualified elsewhere cannot appear on your behalf, although cross-border files are often handled jointly with a Romanian colleague. Proceedings are conducted in Romanian.
Who pays the court fees and my lawyer’s fees?
Court actions attract a judicial stamp fee under Government Emergency Ordinance No 80/2013, calculated on a degressive scale for money claims and payable in advance at first instance and on appeal. Lawyers’ fees are freely negotiated, since there is no binding tariff. If you win, the losing party may be ordered to pay your costs, subject to the court’s view of reasonableness.
Is free legal aid available in Romania?
Public legal aid in civil matters is regulated by Government Emergency Ordinance No 51/2008. It applies where the average net monthly income per family member in the two months before the application is below 300 lei, and it can cover lawyers’, experts’ and bailiffs’ fees as well as exemptions or reductions of court fees, within an annual ceiling.
Which court will hear my case, and can the decision be appealed?
Most civil claims begin before the judecătorii, the local district courts, while the tribunals hear larger first-instance cases and appeals against district court decisions. The 15 courts of appeal hear appeals against tribunal decisions, with the High Court of Cassation and Justice at the apex. Representation by a qualified lawyer is required before the courts of appeal and the High Court.
