Why choose a specialist

Family law in Lithuania, explained clearly

When a marriage ends, child arrangements need to change, or an estate needs to be settled, the right legal support makes a difficult period easier. We help you find family lawyers in Lithuania who are experienced with the Civil Code’s family and succession books. Lithuanian family law follows a civil law model, with statutes as the primary source. Matters such as divorce, matrimonial property, child support and inheritance are governed by the Civil Code and procedural rules. Whether you need to dissolve a marriage before a notary, negotiate a marriage contract, divide joint community property, or claim a compulsory share of an estate, a specialist advocate can guide you. Our matching service is free of charge and connects you with pre-screened lawyers, so you can focus on your next step.

Lithuania at a glance

How family law works in Lithuania

Family matters in Lithuania are shaped by the Civil Code, the Code of Civil Procedure and the Law on the Bar. Below are the key points you should know before speaking with a lawyer.

Courts and key legislation

Family cases are heard in the courts of general jurisdiction, mainly by district and regional courts, with appeals through the Court of Appeal and cassation before the Supreme Court. The Civil Code’s Book Three governs family law, while the Code of Civil Procedure sets out the procedural rules.

Who may represent you

Only an advocate registered with the Lithuanian Bar Association (Lietuvos advokatūra) may use the title advokatas. To qualify, a person must have a university law degree, pass the advocate’s examination, be of impeccable reputation and command Lithuanian. Lawyers qualified in other EU Member States may also provide services under the Law on the Bar.

Divorce before a notary or a court

Since 1 January 2023, spouses can dissolve a marriage by mutual consent before a notary if they have no common minor children, have lived apart for more than one year, and have concluded an agreement on the consequences of divorce. Otherwise, divorce proceedings are brought before a court.

Matrimonial property

The default regime is joint community property: assets acquired for a consideration during marriage belong to both spouses. Property owned before marriage or received as a gift or inheritance remains personal. Spouses may choose separation of property or a mixed regime by a marriage contract concluded before a notary.

Forced heirship

Lithuanian succession law reserves a compulsory share for the deceased’s children, spouse and parents who were dependent at the date of death. They inherit one half of the share they would have received under intestate succession, regardless of the will, unless the will grants more.

State-guaranteed legal aid

Primary legal aid—free legal information, consultation and help with simple documents—is available to everyone through municipalities. Secondary legal aid, including representation in court, is provided by advocates through the State-Guaranteed Legal Aid Service to those whose income and property fall below statutory levels.

Key time limit — Family Law

Divorce (minimum marriage duration, mutual consent) — More than 1 year. Required for notarial divorce or court divorce by mutual consent.

Common concerns

Family legal problems can feel overwhelming

We understand the pressure and help you find the right advocate to address each issue.

01

Uncertainty about the legal process

Family disputes involve strict deadlines and formal requirements. A missed step can delay a divorce or jeopardise a claim. We match you with a lawyer who explains each stage clearly.

02

Complex property and inheritance rules

Lithuanian community property and forced heirship rules differ from many other countries. A local advocate helps you avoid costly misunderstandings about what is shared and what is protected.

03

Language and procedural barriers

Court forms and notarial procedures are in Lithuanian. An advocate who speaks your language and knows the local system prevents errors and represents your interests effectively.

Questions and answers

Family law in Lithuania: FAQs

What do family lawyers in Lithuania handle?

Family lawyers in Lithuania advise on divorce, child custody and support, matrimonial property, marriage contracts and succession. They represent clients before district and regional courts, prepare notarial divorce agreements, and help with cross-border family matters involving Lithuanian law.

Can I divorce before a notary in Lithuania?

Yes, since 1 January 2023, spouses can divorce by mutual consent before a notary if they have no common minor children, have lived apart for more than one year, and have agreed on the consequences. Otherwise the divorce is heard by a court.

What is the default matrimonial property regime?

Lithuania applies joint community property: assets acquired for a consideration during marriage belong to both spouses. Property owned before marriage or received as a gift or inheritance remains personal. A marriage contract can choose separation of property.

How much do family lawyers charge?

Advocates’ fees are freely agreed with the client; there are no official tariffs. The state provides primary legal aid free to everyone and secondary legal aid to those below income thresholds, covering up to 100% of costs.

Do I need a lawyer for family court proceedings?

At first instance you may act in person, but legal representation is required for cassation appeals before the Supreme Court. Given the complexity, most people use a family lawyer to ensure procedural deadlines and documents are correct.

Are foreign judgments on family matters recognised?

Recognition of foreign family judgments in Lithuania depends on EU regulations or bilateral agreements. A lawyer can advise whether a decision from another country will be enforced and what additional steps are needed.
