Family law in Poland

A clear path through Polish family law

When a relationship breaks down or an estate passes in Poland, the rules are set out in the Family and Guardianship Code and the Civil Code, not in case law. Family lawyers in Poland help you understand the statutory community of property that arises automatically on marriage, the forced heirship rules (zachowek) that protect close relatives, and the notarial and Land Register formalities that apply when property changes hands. We match you with an adwokat or radca prawny who works with family law daily, whether your matter is in Warsaw, Kraków, Wrocław or outside Poland. You tell us what you need — divorce, child arrangements, maintenance, property division, a marriage property agreement or an inheritance dispute — and we put you in touch with a specialist who can explain your options and handle the procedure. There is no cost for the matching, and you are not obliged to instruct the lawyer.

Poland at a glance

How family lawyers in Poland work

Poland follows the continental civil law model, with family matters heard in the ordinary courts under the Family and Guardianship Code and the Civil Code. Two legal professions — adwokat and radca prawny — have equal rights of audience before all courts. Below are practical points that matter in Polish family law.

Court structure and family cases

Family matters are handled by the ordinary courts, which are organised in three tiers: district courts (sądy rejonowe) as first-instance courts, regional courts (sądy okręgowe) for more serious or higher-value cases, and appellate courts (sądy apelacyjne) for second-instance appeals. Your lawyer will know the correct court for your divorce, child arrangements or property dispute.

Who may represent you

Poland has two legal professions, the adwokat (advocate) and the radca prawny (attorney-at-law/legal adviser), which since 1 July 2015 enjoy identical rights to appear before all courts, including the Supreme Court. Both are compulsory members of their professional self-government: the Naczelna Rada Adwokacka for advocates and the Krajowa Rada Radców Prawnych for legal advisers.

Matrimonial property and cross-border divorce

Upon marriage a statutory community of property (wspólność ustawowa) arises by law, covering assets acquired by either spouse during the marriage. A notarial marriage property agreement (intercyza) may instead choose separation of property or a limited community. This is essential when advising on cross-border divorce and asset division.

Forced heirship and succession conflicts

Polish succession law restricts testamentary freedom through the zachowek: descendants, the spouse and parents who would inherit on intestacy are entitled to a reserved portion, typically one half or two thirds of their intestate share. Since 2015 an heir who does not declare within six months is deemed to accept the inheritance with the benefit of inventory, limiting liability for debts.

Notarial deed and Land Register formalities

A contract obliging the transfer of ownership of real property must be concluded in a notarial deed (akt notarialny); failure to use this form makes the transaction null and void. Ownership is then recorded in the Land and Mortgage Register (księga wieczysta), which is kept electronically by district courts and searchable online by the KW number.

Costs, fees and legal aid

Lawyers’ fees are freely agreed, with no binding official tariffs. However, a regulation of the Minister of Justice fixes rates used to calculate costs awarded to the winning party and court-appointed lawyers. Persons of limited means may access free legal aid or a court-appointed lawyer, with remuneration paid from public funds.

Key time limit — Family Law

Periodic payments (rent, maintenance, interest) — 3 years. Claims for periodical benefits, such as rent, maintenance or interest, prescribe after three years (Article 118 of the Civil Code).

Common challenges

Where family law gets complicated in Poland

These are the situations where a local specialist makes the difference.

01

Cross-border divorce and property

Divorce involving assets in Poland and abroad can trigger clashes between the statutory community of property and foreign regimes. Without a Polish lawyer, you risk overlooking a notarial marriage property agreement or the rules that decide what is divisible.

02

Forced heirship disputes

If an estate passes in Poland, the zachowek system protects descendants, the spouse and parents with reserved portions. A lawyer can explain how much you or a relative may claim, and help prevent conflicts over the estate.

03

Property division and Land Register

Splitting real estate after separation requires a notarial deed, otherwise the transfer is void. You also need to update the Land and Mortgage Register. A family lawyer manages these formalities so the division is legally effective.

Frequently asked questions

Answers about family lawyers in Poland

What do family lawyers in Poland help with?

Family lawyers in Poland handle divorce, separation, child arrangements, maintenance, division of matrimonial property, prenuptial agreements and inheritance disputes under the Family and Guardianship Code and the Civil Code. They can also advise on cross-border matters and notarial formalities.

Do I need an adwokat or radca prawny for a family case?

Both professions have equal rights of audience before all courts since 1 July 2015. You can choose either; the practical difference is that a radca prawny may be employed under contract, while an adwokat usually practises as a sole practitioner or in a partnership.

How is matrimonial property divided in Poland?

By default, marriage creates a statutory community of property covering assets acquired by either spouse during the marriage. A notarial marriage property agreement (intercyza) may instead choose separation or limited community. A lawyer identifies which assets are common and which are personal.

What are the key deadlines for family law matters in Poland?

Periodic payments such as maintenance have a three-year limitation period. An heir must declare acceptance or rejection of inheritance within six months, otherwise acceptance with benefit of inventory is presumed. Administrative appeals have 14 days. Your lawyer will confirm the deadline for your case.

Can I represent myself in Polish family court?

In principle you may act in person in civil proceedings, but representation by an adwokat or radca prawny is required in many matters, especially before appellate courts and the Supreme Court. A lawyer ensures that procedural and substantive requirements are met.

How much does a family lawyer in Poland cost?

Lawyers’ fees are freely agreed, with no binding official tariffs. Court-awarded costs to the winning party and court-appointed lawyers are capped by statutory rates. Free legal aid or a court-appointed lawyer may be available if you meet the means test.
