How we help

A theft file needs the right advocate early

If property has been taken, or if you are accused of taking it, the consequences can reach far beyond the value of the goods involved. In Moldova a theft allegation is examined within the criminal justice system, where first-instance courts, courts of appeal and the Supreme Court of Justice each play a distinct role and where procedural steps follow strict time limits. Finding a theft lawyer in Moldova early usually matters more than people expect: an advocate can read the file, explain your procedural position and represent you at hearings conducted in Romanian, with free interpretation if you do not speak the state language. On this page we describe how the courts are organised, which time limits the codes set, what state-guaranteed legal aid offers and how our free matching service puts you in contact with an advocate whose work covers criminal matters.

Moldova in detail

How criminal cases work in Moldova

Moldova is a unitary state whose courts are organised along continental European lines, with criminal procedure codified and judicial power exercised only by the courts, independently of the legislative and executive branches. The points below summarise the practical framework using official sources only.

How a theft case moves through the courts

Criminal matters are heard by first-instance courts (judecătorii), where judges are specialised by area, including criminal cases. A judgment may be challenged by appeal (apel) before a court of appeal and afterwards by recourse (recurs) before the Supreme Court of Justice; there is no third ordinary instance, and a decision does not become final until the ordinary remedies are exhausted.

Who may represent you

Legal assistance is provided by advocates registered with the Union of Lawyers of the Republic of Moldova and holding a licence under the Law on advocacy No. 1260/2002. Representation in court normally rests on a legal-assistance contract concluded with the client, and the law permits only narrow exceptions, such as close relatives acting as representatives.

Language of the proceedings

Romanian is the state language and procedural acts are drafted in it. If you do not speak Romanian, you may acquaint yourself with the file and speak through an interpreter free of charge. Legislation is published in the Official Gazette (Monitorul Oficial) and consolidated on the state register Legis.md, which is useful when you want to read a provision yourself.

Fees, court costs and state-guaranteed aid

Advocates’ fees are not fixed by the State: they are agreed in the legal-assistance contract. Judicial fees follow Law No. 213/2023 on the state tax, in force since 1 January 2024, and are paid through the MPay service. State-guaranteed legal aid provides primary advice to everyone and means-tested representation through the National Council for State-Guaranteed Legal Aid and its territorial offices.

Filing documents and the ongoing court reform

Claims, appeals and other procedural documents may be filed through the Integrated Case Management Programme (e-Dosar), which coexists with paper filing and requires an authenticated electronic identity. Since 2022–2023 an extraordinary evaluation (vetting) of judges and prosecutors has been under way, together with a reform of the Supreme Court of Justice and of the appellate map; the Ministry of Justice portal currently lists three courts of appeal.

Key time limits — Criminal Law

Matter Time limit Practical note
Criminal – limitation of criminal liability Variable – depends on the gravity of the offence The applicable period is determined by the criminal law according to the seriousness of the charge.
Criminal – request to accelerate proceedings 5 working days A reasonable-time complaint must be filed within this short window.

Common concerns

What people worry about first

These are the questions clients raise most often before they speak to an advocate.

01

The procedure is unfamiliar

A criminal file moves through fixed stages and short windows. Missing an appeal or a recourse period can close a route for good, so the earlier the file is read by an advocate, the more options remain open.

02

The language barrier

Proceedings in Moldova are conducted in Romanian. Interpretation is free of charge, yet documents, expert reports and court reasoning still need careful reading by someone who knows the terminology and the way the courts apply it.

03

Costs feel unpredictable

Advocates’ fees are agreed in the legal-assistance contract, and state-guaranteed legal aid exists for those who lack sufficient means. Understanding both routes before you commit avoids unpleasant surprises later in the proceedings.

Questions

Frequently asked questions about theft cases in Moldova

How soon should I contact a theft lawyer in Moldova?

There is no single rule that fits every file, but timing matters: procedural documents arrive with short reaction windows, and the limitation period for criminal liability varies with the gravity of the offence. Speaking to an advocate while the investigation is still at an early stage usually gives more room to review evidence and prepare a position.

Can a solicitor from abroad represent me before a Moldovan court?

Legal assistance is reserved for advocates registered with the Union of Lawyers of the Republic of Moldova and holding a licence under the Law on advocacy No. 1260/2002. A foreign lawyer may advise you in their own jurisdiction, but representation before Moldovan courts rests on a legal-assistance contract with a locally registered advocate, with only narrow statutory exceptions such as close relatives.

Is state-guaranteed legal aid available for a criminal theft case?

Primary legal aid — information, advice and drafting of documents — is available to all persons irrespective of income. Qualified legal aid, meaning representation by an advocate before the courts, is granted after a means test, and also irrespective of income in the cases listed by law. It is delivered through the National Council for State-Guaranteed Legal Aid and its territorial offices.

In which language will the hearings take place?

Romanian is the state language and procedural acts are drafted in it. Persons who do not speak Romanian are entitled to acquaint themselves with the file and to speak through an interpreter free of charge, a guarantee rooted in Article 13 of the Constitution and the language provisions of the codes of procedure.

How much does a theft lawyer in Moldova cost?

Advocates’ fees are not fixed by the State: they are freely agreed with the client in the legal-assistance contract, since the profession is independent by law. Court costs, including the costs of legal assistance, may be recovered by a successful party within the limits of the Code of Civil Procedure, which requires them to be necessary and reasonable and allows the court to reduce manifestly excessive claims.

Can a first-instance decision be challenged?

Moldova has two ordinary remedies: appeal (apel) before a court of appeal and recourse (recurs) before the Supreme Court of Justice, which also hears first-instance judgments of a court of appeal directly. There is no third ordinary instance, and a judgment does not become final until the ordinary remedies are exhausted, in line with Article 2 of Protocol No. 7 to the ECHR.
