Why this page exists

Local counsel for companies that build and run technology

If your company builds software, operates a platform or handles personal data, the questions that reach a lawyer are rarely abstract. They arrive as a supplier contract nobody can terminate, an invoice that is not being paid, a partner who leaves with the source code, or a decision you did not expect from an authority. On this page you can describe that situation in your own words, and we will match you with a technology lawyer in North Macedonia who works with these issues routinely. The lawyers in our network practise under the Law on Advocacy and are entered in the register kept by the Bar Association of the Republic of North Macedonia, so you know who is accountable for the advice. Matching is free and you decide whether to go further.

North Macedonia in practice

How technology matters move through the North Macedonian system

North Macedonia follows the continental civil-law tradition, so written codes rather than judicial precedent set the frame for commercial and technology work. A few structural features matter most when you are planning a contract, defending a claim or chasing a debt.

Contracts rest on the Law on Obligations

Commercial arrangements, from software licences to maintenance and reseller terms, are built on the Law on Obligations (Official Gazette No. 18/2001), part of a codified civil-law framework inherited from the former Yugoslav system. That means the wording of your contract and the statutory default rules matter more than a line of past judgments in a similar case.

Which courts hear an IT dispute

Ordinary disputes start in one of the 27 First-Instance Courts and can be appealed to one of four Courts of Appeal, with the Supreme Court as the highest instance ensuring uniform application of the law. Challenges to administrative decisions are heard by the Administrative Court, with review by the Higher Administrative Court.

Who is allowed to act for your company

Only an advokat entered in the register of attorneys maintained by the Bar Association of the Republic of North Macedonia may practise law. That requires a law degree, the bar examination and a prescribed traineeship. In civil proceedings a party may act in person, but only an advokat or a person who has passed the bar examination may lodge a revision before the Supreme Court.

Recovering unpaid invoices without a full trial

North Macedonian notaries exercise public powers beyond certifying documents: they issue notarial enforcement orders on authentic and credible documents for money claims. For a technology supplier with signed invoices and delivery confirmations, that route can be worth examining before a full first-instance claim is drafted and filed.

Costs: fixed court fees and agreed legal fees

Court fees are fixed amounts set in denars under the Law on Court Fees (Official Gazette No. 114/2009 and 148/2011) and its annexed tariff, varying with the value in dispute. Attorneys’ fees are freely agreed with the client, with the Bar Association’s Tariff serving as the reference, and the losing party may be ordered to reimburse the successful party’s costs.

Language and access to free legal aid

Proceedings are conducted in Macedonian, and under the Law on the Use of Languages (Official Gazette No. 7/2019) Albanian is also used in municipalities where at least 20% of the population speaks it. Where means are limited, the Law on Free Legal Aid (Official Gazette No. 101/2019) provides primary advice and, for those below income thresholds, secondary representation.

Common starting points

What clients bring to a technology lawyer in North Macedonia

Most enquiries begin with a commercial problem rather than a legal label. These are the situations we see most often.

01

A contract you cannot exit

A platform agreement, distributor deal or development contract was signed quickly and now binds you to terms nobody can live with. You need the exit routes, the notice periods and the realistic options read against the applicable law.

02

Invoices that are not being paid

A client or reseller has stopped paying while still using your software. You want to know how to recover the money, what evidence you need and whether a faster route than litigation is open to you.

03

A dispute over code or data

A partner, contractor or former employee has taken code, data or customer lists, or claims ownership of work you commissioned. The question is what you can prove and what you can demand.

How matching helps

Why clients use our matching service

You get a shortlist, not a directory. The point is to reach a lawyer who already understands the type of problem you have.

Scoped to technology work

We match you with lawyers who handle software, licensing, data protection and IT disputes, rather than general practitioners meeting the topic for the first time on your file.

Qualified in North Macedonia

Every lawyer in the network practises under the Law on Advocacy and appears in the register maintained by the Bar Association of the Republic of North Macedonia, so representation is properly grounded in local procedure.

You describe it once

Instead of repeating the background to five firms, you explain the situation once in plain language and we use that description to identify the most relevant lawyers for your matter and your budget.

Free, and without pressure

Matching costs nothing and places you under no obligation. You decide whether to instruct the lawyer after the first conversation, when you understand the approach, the likely steps and how fees would be agreed.

Questions

Frequently asked questions

What does a technology lawyer in North Macedonia actually handle?

Typically software development and licensing contracts, reseller and maintenance agreements, data protection questions, IT outsourcing, ownership of code and content, and disputes over unpaid invoices or failed deliveries. Because commercial relations rest on the Law on Obligations, the drafting of the contract and the statutory default rules carry most of the weight rather than earlier judgments.

Can my in-house counsel represent the company in court?

Under the Law on Advocacy, only an advokat entered in the register of the Bar Association of the Republic of North Macedonia may practise law. In civil proceedings a party may act in person, but a revision before the Supreme Court may only be lodged by an advokat or a person who has passed the bar examination, so local counsel is needed at that stage.

Which court will hear an IT or software dispute?

Ordinary civil claims start before one of the 27 First-Instance Courts, with appeal to one of four Courts of Appeal and ultimately the Supreme Court, which ensures uniform application of the law. If the dispute concerns an administrative decision, the Administrative Court decides, with the Higher Administrative Court reviewing legality.

How long do we have to pursue an unpaid invoice?

For mutual commercial claims arising from the exchange of goods and services, the limitation period is 3 years. General contractual and debt claims fall under a 5-year period, and a claim already confirmed by a final court decision or a settlement can be enforced for 10 years. The facts of the individual invoice determine which rule applies.

Can the proceedings be run in English?

No. Court proceedings are conducted in Macedonian, and under the Law on the Use of Languages Albanian is also used in municipalities where at least 20% of the population speaks it, with documents issued in both languages. Contracts and correspondence in English remain evidence, but filings and hearings follow the court’s language.

What does it cost to instruct a lawyer, and is help available?

Attorneys’ fees are freely agreed between lawyer and client, with the Bar Association’s Tariff used as a reference, and the losing party may be ordered to reimburse the successful party’s costs. Court fees are fixed amounts in denars. The Law on Free Legal Aid provides primary advice and, below income thresholds, secondary representation.
