How matching works

Legal help after an accident in Portugal

An accident in Portugal — on the road, at work, in a shop or while on holiday — can leave you dealing with insurers, hospitals and paperwork in a language you may not speak. Civil liability claims in Portugal are handled by lawyers registered with the Ordem dos Advogados, and the courts that hear them conduct proceedings in Portuguese. Our free matching service puts you in contact with a personal injury lawyer in Portugal who works on compensation claims arising from road traffic accidents, workplace incidents, medical harm and other negligent acts. You describe what happened, we identify the lawyers whose practice fits your situation, and you decide whether to proceed. There is no cost to be matched and no obligation to instruct the lawyer you speak to.

Local context

How injury claims work in Portugal

Portuguese civil liability claims run on written codes and a court structure that differs from common-law systems, and the language of the proceedings is Portuguese. These are the practical points that shape an injury claim in Portugal.

Only registered lawyers may act for you

In Portugal, representing a client before the courts is a reserved activity. Membership of the Ordem dos Advogados is compulsory to practise, and the title of lawyer and the acts reserved to lawyers depend on prior registration under the Estatuto da Ordem dos Advogados (Law 145/2015). Performing those acts without registration is ‘procuradoria ilícita’, a criminal offence under Law 49/2004.

When representation by a lawyer is mandatory

Under Article 40 of the Civil Procedure Code, parties must be represented by a lawyer in proceedings where representation is mandatory — in general, actions and appeals above the first-instance court’s alçada of €5,000, and always in appeals before the Courts of Appeal and the Supreme Court. Below that threshold you may appear in person, though legal advice still matters.

Where a compensation claim is heard

Civil claims, including those arising from accidents, are heard at first instance by the judicial courts (tribunais judiciais), currently organised into 23 comarcas and subdivided into juízos by specialisation. Appeals (apelação) go to one of the five Courts of Appeal — Lisbon, Porto, Coimbra, Évora and Guimarães — while the Supreme Court of Justice in Lisbon deals with cassation and uniformisation of case law.

The language of the proceedings

Court proceedings in Portugal are conducted in Portuguese, and the substantive rules come from written codes, principally the Civil Code and the Civil Procedure Code. A lawyer registered with the Ordem dos Advogados handles correspondence, filings and hearings on your behalf, which matters if you have returned home or are still receiving treatment after the accident.

What a claim costs and who pays

Court costs are governed by the Regulamento das Custas Processuais. The court fee (taxa de justiça) is expressed in Unidade de Conta, a unit of account updated annually in line with the social support index, and is set by reference to the value and complexity of the case. As a rule the losing party bears the court costs. Lawyers’ fees are freely agreed, with no binding official tariffs.

Legal aid and time limits

Legal aid (apoio judiciário) under Law 34/2004 is available to those who demonstrate economic insufficiency, assessed by the Social Security Institute; it can exempt you from the court fee and provide a lawyer. Timing matters: a general limitation period of 20 years is recorded, but five-year and shorter presumptive periods of six months or two years also exist. Your lawyer identifies which applies.

Common problems

What makes an injury claim in Portugal difficult

Three situations we hear about most often from people injured in Portugal or visiting from abroad.

01

The insurer moves faster than your recovery

You are still recovering when the insurer makes a first offer and asks for a quick signature. Settling before the full extent of your treatment and lost income is known can leave you with nothing further to claim.

02

Portuguese procedure, Portuguese language

Filings, court fees and hearings follow written Portuguese codes and are conducted in Portuguese. Without someone who works in that system regularly, procedural steps and time limits are easy to miss.

03

Not sure who you are dealing with

Search results mix registered lawyers with unregulated claims intermediaries. In Portugal only lawyers registered with the Ordem dos Advogados may perform the acts reserved to lawyers, so checking that registration is the sensible first step.

Questions

Personal injury claims in Portugal: frequently asked questions

Do I need a personal injury lawyer in Portugal, or can I deal with the insurer myself?

You are free to negotiate with an insurer directly, but the acts reserved to lawyers — issuing proceedings, filing pleadings and representing you in court — can only be performed by a lawyer registered with the Ordem dos Advogados. Most people instruct a lawyer once the medical picture and the extent of their loss are clearer.

How do I check that a lawyer in Portugal is properly qualified?

Practising law in Portugal requires registration with the Ordem dos Advogados. The title of lawyer and the acts reserved to lawyers depend on that registration under the Estatuto da Ordem dos Advogados (Law 145/2015), and performing those acts without it is ‘procuradoria ilícita’, a criminal offence under Law 49/2004.

Where are personal injury claims heard in Portugal?

Compensation claims are civil matters, heard at first instance by the judicial courts (tribunais judiciais), which are organised into 23 comarcas and divided into juízos by specialisation. Appeals go to the Courts of Appeal in Lisbon, Porto, Coimbra, Évora or Guimarães, while the Supreme Court of Justice in Lisbon deals with cassation and uniformisation of case law.

How much does it cost to pursue a claim in Portugal?

Court costs follow the Regulamento das Custas Processuais and the court fee is expressed in Unidade de Conta, a unit of account updated annually in line with the social support index. As a rule the losing party bears the court costs. Lawyers’ fees are freely agreed between lawyer and client, with no binding official tariffs.

Can I get legal aid for a claim in Portugal?

Legal aid (apoio judiciário) and legal advice are guaranteed under Law 34/2004 for natural and legal persons who demonstrate economic insufficiency, assessed by the Social Security Institute. The available modalities include exemption from the court fee, appointment and payment of a lawyer, phased payment of fees, and appointment of an enforcement agent.

How long do I have to bring a claim in Portugal?

Portuguese law records a general limitation period of 20 years, alongside a five-year period for periodic payments, rent, interest and fees, and shorter presumptive periods of six months or two years for certain categories. Because more than one may be relevant to an accident, a Portuguese lawyer should confirm the applicable period early.
