Your situation
When sick leave turns into a legal problem
Being on sick leave in Portugal can become a dispute: an employer may question the medical justification, delay or stop salary payments, or treat your absence as a disciplinary matter. Employment relations here are governed by the Labour Code (Código do Trabalho) inside a civil-law system based on written codes, so the answer to your problem depends on your contract and the facts of your absence rather than on general rules you read online. That is why a sick leave lawyer in Portugal is often the quickest way to understand where you stand. Tell us what happened and we match you — free of charge — with a lawyer who regularly handles employment and incapacity matters before the Portuguese courts.
Portugal in practice
How employment and sick leave matters work in Portugal
Portugal is a civil-law country where employment relations are regulated mainly by written codes rather than by binding case-law alone. Disputes over sick leave, pay during absence or dismissal usually reach the labour benches of the judicial courts, where only lawyers registered with the Ordem dos Advogados may represent you. The framework below shows what your lawyer will be working within.
The courts that hear your case
First-instance judicial courts (tribunais judiciais) are organised into 23 comarcas, each divided into specialised sections (juízos) that include labour benches. A sick leave or dismissal dispute is normally filed there. Appeals go to one of the five Courts of Appeal — Lisbon, Porto, Coimbra, Évora and Guimarães — and, on points of law, to the Supreme Court of Justice in Lisbon.
Who is allowed to represent you
Practising law in Portugal is a reserved activity: only lawyers registered with the Ordem dos Advogados may perform the acts reserved to the profession, and doing so without registration is ‘procuradoria ilícita’ under Law 49/2004. Representation is mandatory in general actions and appeals above the first-instance alçada of €5,000, and always before the Courts of Appeal and the Supreme Court.
Deadlines you should not miss
Portuguese procedural and limitation periods are strict. A challenge to a dismissal must be brought within 60 days, an appeal against a judgment within 30 days (15 in urgent proceedings), and the general limitation period is 20 years, with a shorter five-year period for periodic payments such as rent, interest and fees. Missing the right period can bar a claim altogether.
What it costs and how fees work
Court costs are governed by the Regulamento das Custas Processuais and expressed in a Unidade de Conta (UC), a unit of account updated annually in line with the social support index — so the amounts change each year. Lawyers’ fees, by contrast, are freely agreed between lawyer and client, with no binding official tariffs, and may be fixed by written agreement.
Legal aid if money is tight
Legal aid (apoio judiciário) under Law 34/2004 is guaranteed to people who demonstrate economic insufficiency, assessed by the Social Security Institute. It can include exemption from court fees and charges, the appointment and payment of a lawyer, and phased payment of fees. A lawyer can tell you whether your circumstances are likely to qualify.
Language and distance
Proceedings before the Portuguese courts are conducted in Portuguese, and filings and judgments are issued in that language. A lawyer registered with the Ordem dos Advogados prepares your submissions, attends hearings and handles correspondence, and can keep you informed if you live outside Portugal. That makes it workable to pursue a sick leave dispute from abroad.
Key time limit — Employment Law
Challenge to a dismissal from employment — 60 days. A dismissal must be contested within this period after the relevant event.

Common problems
Situations clients bring to us
These are the patterns we see most often when sick leave and employment overlap in Portugal.
Your employer questions the certificate
You are signed off work, but your employer disputes the justification, delays payment or asks you to return early. A lawyer can review your contract and the applicable rules before you reply, so your response is not improvised.
Dismissal while you are absent
Being dismissed during a period of sick leave raises specific questions, and a dismissal must be challenged within 60 days. Waiting too long can cost you the ability to contest it at all, so early advice matters.
Uncertainty about pay and records
You may not know how your absence affects salary, allowances, seniority or your employment record. Legal advice turns a vague worry into a short, concrete list of options you can act on.
Why use our service

Explaining your situation costs nothing and commits you to nothing. You receive a match with a lawyer who handles employment and incapacity matters, and you decide independently whether to instruct them.
A clear view of deadlines
Portuguese limitation and procedural periods are strict, and different claims run to different clocks. Your lawyer identifies the periods that apply to your circumstances so you can act in time.

Questions
Frequently asked questions about sick leave and Portuguese employment law
Do I need a sick leave lawyer in Portugal?
If your employer disputes your absence, withholds pay or moves towards dismissing you, a lawyer helps you understand your position under Portuguese employment law and the periods that apply. Employment disputes are heard within the ordinary judicial courts, and only lawyers registered with the Ordem dos Advogados may represent you there.
How long do I have to challenge a decision linked to my sick leave?
Portuguese law sets firm periods. A challenge to a dismissal must be brought within 60 days, and an appeal against a judgment must be lodged within 30 days, or 15 days in urgent proceedings. Because the applicable period depends on how your case is framed, a lawyer should confirm the deadline that applies to you.
Will my case have to go to court?
Not necessarily. Many employment matters are resolved through correspondence, negotiation or settlement before anything is filed. If litigation is needed, it is heard at first instance by the labour benches of the judicial courts within one of Portugal’s 23 comarcas, with appeals to the Courts of Appeal and, on points of law, to the Supreme Court of Justice.
What does a lawyer cost in Portugal?
Lawyers’ fees are freely agreed with the client — there are no binding official tariffs — and can be fixed by written agreement (honorários acordados). Court costs are separate and are expressed in a Unidade de Conta, updated each year. Where means are limited, legal aid under Law 34/2004 may cover costs and a lawyer.
Can I apply for legal aid in Portugal?
Legal aid (apoio judiciário) under Law 34/2004 is available to people who demonstrate economic insufficiency, which is assessed by the Social Security Institute. It can include exemption from the court fee and other charges, the appointment and payment of a lawyer, and phased payment of fees, depending on your circumstances.
What if I live outside Portugal?
You can still instruct a Portuguese lawyer, who prepares filings and attends hearings on your behalf in Portuguese. Proceedings themselves are conducted in Portuguese, and your lawyer can keep you informed remotely. This is common where a cross-border employment arrangement connects someone abroad with a Portuguese employer.
