The situation

Why a local lawyer changes the picture

Dealing with the Portuguese tax authority can feel like a conversation you are not allowed to join: assessments arrive, deadlines run and the language of the file is not yours. An income tax lawyer in Portugal works inside that system every week — reading the assessment, checking which period it covers, and deciding whether the route lies with the tax authority itself or before the administrative and tax courts. Because Portugal keeps tax litigation in a separate branch of the judiciary from civil and criminal cases, experience with that branch matters. Our free matching service listens to your situation and puts you in touch with a Portuguese-registered lawyer who handles income tax and tax dispute work. You decide whether to instruct; there is no charge for the introduction.

Portugal in practice

How the Portuguese framework actually works

Portugal deals with tax disputes in a distinct branch of its judiciary, and the rules on who may act for you, how fees are built and how long you have to react are all specific to the country. The blocks below set out the framework any lawyer you instruct will be working inside.

Only registered lawyers may act for you

The practice of law in Portugal is a reserved activity. Performing the acts reserved to lawyers requires registration with the Ordem dos Advogados under the Estatuto da Ordem dos Advogados (Law 145/2015, as amended). Acting without that registration is ‘procuradoria ilícita’, a criminal offence under Law 49/2004, so it is worth checking registration before you instruct anyone.

Where tax disputes are heard

Under Articles 209 et seq. of the Constitution, Portugal has two separate sets of courts: the judicial courts and the administrative and tax courts. Tax litigation begins in the administrative and tax courts, with appeals to the Central Administrative Courts and, ultimately, the Supreme Administrative Court. The Constitutional Court reviews the constitutionality of legislation outside the ordinary judiciary.

A code-based system, not a precedent-based one

Portugal follows the continental, Romano-Germanic model: written codes rather than binding judicial precedent are the starting point, from the Civil Code of 1967 to the Civil Procedure Code of 2013. Supreme Court judgments, and above all uniformisation rulings (acórdãos de uniformização de jurisprudência), guide how the law is read, so knowing the settled line of authority matters as much as knowing the statute.

Court fees are expressed in a unit of account

Court costs in Portugal are governed by the Regulamento das Custas Processuais (Decree-Law 34/2008) and unified across civil, criminal, administrative and tax proceedings. The taxa de justiça is not fixed in euros but in a Unidade de Conta (UC), updated annually in line with the social support index, and depends on the value and complexity of the case. A remanescente may be charged above €275,000.

Fees, costs and legal aid

Lawyers’ fees in Portugal are freely agreed between lawyer and client, with no binding official tariffs; absent a written agreement they are assessed by complexity, time and responsibility. The losing party may be ordered to reimburse the successful party’s ‘custas de parte’ within limits. Legal aid under Law 34/2004 is available where economic insufficiency is shown to the Social Security Institute.

Mandatory representation and language

Under Article 40 of the Civil Procedure Code, parties must be represented by a lawyer in proceedings where representation is mandatory — in general, actions and appeals above the first-instance alçada of €5,000, and always before the Courts of Appeal and the Supreme Court. Proceedings are conducted in Portuguese.

Common problems

What usually goes wrong before a lawyer is involved

Most damage in a Portuguese tax file is done quietly, before anyone has read the document properly.

01

Deadlines you did not know existed

Three months to bring a judicial challenge against an administrative act, 30 days to appeal a judgment. If nobody explains the calendar, the strongest argument can expire while you are still gathering paperwork.

02

A tax system written in Portuguese

Assessments, notices and court filings arrive in Portuguese and follow a code-based system in which settled lines of authority carry real weight. Reading them without local training makes it hard to see which arguments the courts actually accept.

03

Not knowing who is allowed to act

In Portugal, the acts reserved to lawyers can only be performed by a lawyer registered with the Ordem dos Advogados. Anyone else doing so commits procuradoria ilícita under Law 49/2004, so credentials should be checked early.

Why us

How our matching works for Portugal

One short description of your situation is enough to start; we do the filtering for you.

Screened for Portuguese tax experience

We look for lawyers who work with income tax and the administrative and tax courts, rather than generalists who take a tax file once a year. Experience with that branch of the judiciary is the first filter we apply.

One short form, no long calls

Describe the assessment, the letter or the decision and the date on it. We pass that to lawyers who handle comparable matters and come back to you with a match, usually within 24 to 48 hours.

Clear on costs from the start

In Portugal, lawyers’ fees are freely agreed and there are no binding official tariffs, so you should know the basis before instructing. We tell you what to ask about fees, court costs in unidades de conta, and legal aid under Law 34/2004.

Matched on language as well

Proceedings in Portugal are conducted in Portuguese, but the initial conversation does not have to be. Tell us the language you are comfortable in and we look for a lawyer who can work with you in it.

FAQ

Income tax and tax disputes in Portugal: common questions

How do I find a trustworthy income tax lawyer in Portugal?

Start by checking that the lawyer is registered with the Ordem dos Advogados, because only registered lawyers may perform the acts reserved to lawyers in Portugal; acting without registration is procuradoria ilícita under Law 49/2004. Our service compares lawyers who handle tax work and introduces you to one who fits your case. You then decide whether to instruct them.

Which courts deal with tax cases in Portugal?

Portugal separates its judiciary into judicial courts and administrative and tax courts. Tax litigation starts in the administrative and tax courts, appeals go to the Central Administrative Courts and ultimately to the Supreme Administrative Court. The Constitutional Court reviews constitutionality outside the ordinary judiciary. Because this branch is separate, a lawyer who works there regularly reads a file differently from a general practitioner.

How long do I have to challenge a tax decision?

A judicial challenge of an administrative act must be brought within three months. If a court has already decided and you want to appeal, the recurso de apelação must generally be filed within 30 days, or 15 days in urgent proceedings. General limitation periods are far longer, 20 years for ordinary claims and five years for periodic payments, but the applicable period depends on the type of claim.

How much does an income tax lawyer in Portugal cost?

Portuguese lawyers’ fees are freely agreed with the client; there are no binding official tariffs. Where there is no written agreement, fees are assessed by complexity, time and responsibility. Court costs follow the Regulamento das Custas Processuais and are expressed in a Unidade de Conta updated annually with the social support index. If you demonstrate economic insufficiency, legal aid under Law 34/2004 may cover fees and representation.

Can a lawyer from another EU country handle my Portuguese tax case?

Yes, in two ways. An EU lawyer may establish in Portugal under their home professional title after registering with the Ordem dos Advogados, or be fully admitted after passing an aptitude exam. Either way, Bar registration is the condition for performing the acts reserved to lawyers in Portugal, and proceedings themselves are conducted in Portuguese.

Should I reply to the tax authority before consulting a lawyer?

We cannot advise you on what to do in your file, and the answer depends on the document you received, the period it covers and the deadline attached to it. What we can do is shorten the search: describe your situation in a few lines and we introduce you to a lawyer registered in Portugal who handles income tax matters.
