Your situation
Why a Slovak disposal needs local legal input
Selling a flat in Bratislava, a shareholding or a business in Slovakia can leave you with a tax question that is hard to answer from abroad. The paperwork, the registration step and the correspondence from the authorities each follow their own logic, and a gap in one area tends to surface later in another. A capital gains tax lawyer in Slovakia can look at what you sold, how the gain was put together and what the tax administration has actually asked you, then explain the options in plain terms. On this page you describe the matter once, tell us the language you prefer and the city involved — Bratislava, Košice, Prešov, Žilina or elsewhere — and we match you with a lawyer whose practice covers disposals and tax disputes. Matching is free and carries no obligation.
Slovakia in practice
The Slovak framework around a disposal or tax dispute
Slovakia is a civil-law country working from written codes, and its procedural rules shape how a tax question is handled long before anything reaches a hearing. These are the parts of the framework that most often affect a client who has sold property, shares or a business in the country.
Who is entitled to act for you
Legal services in Slovakia are reserved to lawyers entered in the register of the Slovak Bar Association (Slovenská advokátska komora). Practice is governed by Act No 586/2003 Coll. on the Legal Profession; admission requires a Slovak law degree or a recognised equivalent, three years as a trainee lawyer and the Bar examination. Notaries and enforcement officers cover their own reserved fields.
Where a tax dispute is decided
Since 2021 Slovakia has had a self-standing administrative judiciary. The Supreme Administrative Court was created by Constitutional Act No 422/2020 with effect from 1 August 2021, and Act No 151/2022 Coll. established three administrative courts that review the legality of public-administration decisions. Constitutional complaints go to the Constitutional Court, which stands outside the ordinary courts.
The language of the file
Slovak is the state language under Article 6 of the Constitution and the language of judicial and administrative proceedings. Documents are served in Slovak, and parties who do not command the language are entitled to an interpreter. Article 47 guarantees legal assistance from the start of proceedings, which is why authority correspondence should be translated before you answer it.
What legal help and court fees cost
Lawyers’ fees follow Implementing Decree No 655/2004: either a tariff fee linked to the value of the matter or a contract fee agreed with the client, so there is no single state-fixed price. Court fees under Act No 71/1992 Coll. are generally 6% of the value in dispute, with a EUR 25 minimum and a EUR 33,000 cap for ordinary civil claims.
Property disposals and the Land Register
The Slovak Land Register (kataster nehnuteľností) works on the constitutive principle: ownership is acquired and transferred only on registration, not on signature of the contract. Entering the ownership right costs a flat EUR 66, or EUR 33 for electronic filing. Slovakia abolished inheritance and gift tax in 2004 and real-estate transfer tax in 2005, so registration is the step to watch.
Precedent and the higher instances
Slovakia does not apply binding precedent: Supreme Court case law unifies the interpretation of the law, but arguments are built from the written codes. Representation by a lawyer is mandatory for a dovolanie before the Supreme Court and for proceedings before the Constitutional Court, even though a natural person may appear in person in most first-instance civil matters.

What brings clients to us
The three situations we see most often
Most enquiries about a Slovak disposal begin with a letter, a deadline or a figure that does not look right.
The figure on the notice does not match your own calculation
You worked from the purchase price and the sale price. The authorities may be looking at acquisition costs, improvements or the way the asset was held. A Slovak-qualified lawyer can compare the assessment with the documents you actually have.
Correspondence arrives in Slovak while the clock runs
Administrative appeal windows are short, and a decision served in the state language is easy to set aside. Translation and a legal read of the decision usually need to happen together rather than one after the other.
The asset was held within the spouses’ community property
Slovak community property (BSM) is the default regime, covering most property acquired during the marriage with defined exceptions. Where such an asset is sold, settling the community can become a question in its own right.
How matching works
What you get from the free matching
You describe the matter once; we look for a lawyer whose practice actually covers it in Slovakia.
A lawyer registered in Slovakia
We match you with an advokát entered in the Slovak Bar Association register, not with an adviser working from another jurisdiction and guessing at local practice.
Fit with the disposal you made
Property, shares, a business sale or a dispute with the tax administration: the intake is built around the type of asset and the stage your file has reached.
One short intake, then a conversation
You explain the situation once, in the language you prefer, and indicate the city involved so the practical arrangements stay manageable.
Cross-border details kept in view
If you live outside Slovakia, the file usually involves language, service of documents and a registration step in the Land Register that has to be sequenced properly.
Cross-border matters
Where else can we match you with a lawyer?
If your matter touches more than one jurisdiction, it helps to know where the same matching service exists. These are the European countries most often paired with a Slovak file.
Frequently asked
Questions about capital gains and Slovak procedure
How do I find a capital gains tax lawyer in Slovakia?
Describe the disposal — what was sold, when, and what you have already received from the tax administration. We match you with a Slovak-qualified lawyer whose practice covers disposals and tax disputes. The matching is free, and you decide afterwards whether to instruct that lawyer.
Must my representative be a member of the Slovak Bar Association?
Yes, if you want a lawyer. Practice is governed by Act No 586/2003 Coll., and only lawyers entered in the Slovak Bar Association register may provide legal services, alongside notaries and enforcement officers in their reserved fields. A register check is therefore a quick, verifiable test of who may act.
In what language will my Slovak tax matter be handled?
Slovak is the state language and the language of administrative and judicial proceedings, and documents are served in Slovak. You are entitled to an interpreter if you do not command the language. In practice, documents should be translated and understood before any reply or appeal is filed.
What will a Slovak lawyer cost for a disposal question?
Fees follow Implementing Decree No 655/2004 and take the form of either a tariff fee or a contract fee agreed with you, so there is no single official price. Ask for the basis of the fee in writing. If you are in material need, state-funded legal aid is available through the Centre for Legal Aid under Act No 327/2005 Coll.
Can I deal with a Slovak tax dispute without a lawyer?
In most civil matters a natural person may act in person before the district and regional courts, so first-instance steps are not automatically barred. Representation is mandatory, however, for a dovolanie before the Supreme Court and in proceedings before the Constitutional Court. In administrative matters a lawyer is often practically necessary.
Does selling Slovak property require registration?
The Land Register applies the constitutive principle, so ownership of real property is acquired and transferred only upon registration, not when the contract is signed. Entering the ownership right costs a flat EUR 66, or EUR 33 for electronic filing. Slovakia charges no real-estate transfer tax.
