Why this page exists

A Hungarian disposal is rarely only a tax question

If you have sold, or are about to sell, Hungarian property, shares in a Hungarian company or another asset, the tax position is only one part of the picture. Contracts must be drafted and checked, title and company records verified, time limits respected and any dispute brought before the right forum. We are a European matching platform, not a law firm: you describe your situation and we introduce you to a capital gains tax lawyer in Hungary whose practice covers exactly that kind of work. You keep control of the mandate, agree the fee directly with the lawyer, and pay nothing to be matched. The introduction is free, non-binding and usually answered within one working day.

Hungary in practice

How legal work around a Hungarian asset disposal is structured

Hungary is a continental, civil-law country where private-law rules sit in written codes rather than in judicial precedent. The procedural framework and the way lawyers are admitted to practice shape how a disposal, a filing or a disagreement is handled.

Private law is codified

Hungary follows the continental, civil-law model: the rules are found in written codes rather than in judicial precedent. The current Civil Code, Act V of 2013 (Polgári Törvénykönyv), entered into force on 15 March 2014 and replaced the 1959 code, unifying persons, family law, property, obligations and succession in a single instrument of eight Books.

The courts that decide disputes

Judicial power rests with the courts, organised as 158 courts in four tiers: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék) and regional courts of appeal (ítélőtábla), headed by the Curia (Kúria) in Budapest. Higher courts cannot give instructions to lower ones, and judges decide independently.

Who may act for you

To practise as an attorney-at-law (ügyvéd) in Hungary you must be a member of a regional bar association, and those associations form the Hungarian Bar Association (Magyar Ügyvédi Kamara, MÜK), seated in Budapest. A person admitted to the bar may practise throughout the whole territory of Hungary under Act LXXVIII of 2017.

When representation is mandatory

Representation by an attorney is mandatory in litigation unless an Act provides otherwise, but it is not required in actions falling within the subject-matter jurisdiction of the district courts (járásbíróság), including appeals and retrial. Before the regional court and the higher courts an attorney is needed. Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents.

How fees and court fees work

There is no binding statutory tariff for attorneys: fees are freely agreed between lawyer and client by mandate, and fee agreements are governed by Act LXXVIII of 2017, which also regulates the professional guarantee and indemnity insurance attorneys must maintain. Court fees in civil proceedings follow the tiered scale under Act XCIII of 1990, as reformed on 28 January 2025.

Legal aid for limited means

Legal aid (jogi segítségnyújtás) is regulated by Act LXXX of 2003 and can cover advice, drafting and representation in civil, labour and administrative matters for persons of limited means, together with exemption from or deferral of procedural costs. Eligibility depends on the social reference base, whose forint value is set each year in the central budget act.

Common situations

What usually brings people to this page

Disposals rarely fail for one single reason. These are the recurring problems we see when a Hungarian asset changes hands.

01

The tax charge surfaces after completion

The transfer is registered and the money has moved before anyone asks how the disposal will be treated, who must declare it and what evidence is needed to support the figures.

02

Two countries, one transaction

You may be resident elsewhere while the asset, the buyer or the company sits in Hungary, so more than one authority takes an interest and the paperwork must fit together.

03

Documents in a language you do not read

Contracts, company extracts and court papers are in Hungarian, and the procedure follows a codified system that is unfamiliar if you have only dealt with common-law jurisdictions.

How we help

A calmer route to the right Hungarian lawyer

We do not give legal advice and we do not decide your case. We shorten the search and put you in front of someone who already works on files like yours.

Practice-matched, not random

We look at the nature of your disposal — property, shares, business assets, a dispute — and match you with lawyers whose declared practice covers that area in Hungary.

Admitted to a Hungarian bar

Every lawyer we introduce practises as a member of a regional bar association and is therefore entitled to act throughout the whole territory of Hungary under Act LXXVIII of 2017.

You agree the fee directly

There is no binding statutory tariff for attorneys in Hungary. The fee basis is agreed between you and the lawyer, so you see the terms before anything starts.

Nothing to pay for matching

Describing your situation and receiving an introduction costs you nothing, and it commits you to nothing. You decide whether to instruct the lawyer afterwards.

Questions

Frequently asked questions

Do I need a capital gains tax lawyer in Hungary if I sell an asset there?

In many straightforward disposals an accountant can prepare the figures, but a lawyer becomes useful when contracts, title, company records or a dispute are involved. Hungarian private law is codified, and only attorneys-at-law, law offices and registered in-house legal counsels may act as agents in court. We match you with a lawyer whose practice covers that work.

How are lawyers’ fees set in Hungary?

There is no binding statutory tariff for attorneys-at-law in Hungary. Fees are freely agreed between you and the lawyer by mandate, and fee agreements are governed by Act LXXVIII of 2017, which also regulates the professional guarantee and indemnity insurance an attorney must maintain. Agree the basis of charging in writing before work begins.

Can I be represented in a Hungarian court?

Representation is mandatory in litigation unless an Act provides otherwise, but you may appear in person in actions within the subject-matter jurisdiction of the district courts (járásbíróság), including appeals and retrial procedures. Before the regional court (törvényszék) and the higher courts, an attorney-at-law is required.

How long do I have to bring a claim in Hungary?

The general limitation period for debt recovery is five years, and a compulsory share claim also lapses after five years. Labour law claims for wages or damages run for three years, while an unlawful dismissal must be challenged within 30 days and an administrative appeal filed within 15 days. Company resolutions face a 30-day limit with one-year preclusion.

Is legal aid available in Hungary?

Legal aid under Act LXXX of 2003 can cover legal advice, the drafting of documents and representation in civil, labour and administrative matters, plus exemption from or deferral of procedural costs. Eligibility is assessed against the social reference base, whose forint value is fixed each year in the central budget act.

What does your matching service cost?

Nothing. You describe your situation, we compare it with lawyers whose practice covers asset disposals and related disputes in Hungary, and you decide whether to instruct. We are not a law firm and we do not give legal advice; the mandate and the fee agreement are concluded directly between you and the lawyer.
