The framework in Andorra

Injury claims in a small country with its own procedure

If you are injured in Andorra — in a road traffic collision, at work, in a shop or on a building site — the practical questions are who may act for you and how the claim is run. Andorra is a parliamentary co-principality with a fully separated judicial power, and civil claims begin before the Batllia d’Andorra, with appeals going to the Tribunal Superior de Justícia. Legal practice is reserved to advocates admitted to the Col·legi Oficial d’Advocats d’Andorra (CADA), and the same lawyer both represents and pleads your case, because there is no separate procurador profession. Proceedings are conducted in Catalan. Tell us what happened and we will match you, free of charge, with a personal injury lawyer in Andorra who handles injury claims.

Andorra in detail

How the Andorran system shapes an injury claim

Injury matters in Andorra are decided under Andorran civil and criminal procedure, in Catalan, by courts whose structure and deadlines differ from those of neighbouring countries. The notes below set out the framework that applies, taken from official Andorran sources.

Where a claim is heard and appealed

The Llei qualificada de la Justícia of 3 September 1993 allocates judicial power to the Batlles, the Tribunal de Batlles, the Tribunal de Corts and the Tribunal Superior de Justícia, and structures it into civil, criminal and administrative jurisdictions. The Batllia d’Andorra hears first-instance matters and carries out investigation; the Tribunal de Corts deals with serious criminal offences; the Tribunal Superior de Justícia is the highest instance and hears appeals.

Who may represent you

The practice of law in Andorra is reserved to advocates admitted to the Col·legi Oficial d’Advocats d’Andorra, regulated by Law 48/2014 of 18 December, as amended by Law 10/2023 of 30 January. Admission as a practising member requires the required law degree, the Andorran aptitude certificate (certificat d’aptitud) obtained after examinations, and a practical traineeship. There is no separate procurador profession: the same lletrat represents and defends you in court.

Everything is filed in Catalan

Catalan is the sole official language of the Andorran State and of judicial activity. Proceedings, filings and judgments are in Catalan, which is a practical point for foreign clients and for the drafting of any document intended to be used before the Andorran courts. Hospital notes, police reports and employer records generated in the Principality will normally be in Catalan as well.

Court fees and lawyers’ fees

Judicial fees (taxes judicials) exist in Andorra under the Llei de taxes judicials of 22 June 2000. Article 2.1 taxes proceedings in the civil jurisdiction, in the administrative jurisdiction and civil liability claims brought within criminal proceedings; criminal proceedings as such are not subject to the fee. The claimant is the taxpayer and the fee counts as procedural costs. Advocates’ fees are freely agreed between client and lawyer.

Free legal aid

Legal aid (benefici de justícia gratuïta) is granted by the judge, by reasoned order, to persons who prove insufficient economic resources, taking into account income, basic expenses, dependent family members and patrimonial situation. It covers the duty advocate’s assistance for a detained person, defence and representation throughout the same criminal proceeding, authorised procedural expenses, and free judicial copies. A decision is due within one month of a complete application.

Statute, custom and case law together

Andorran civil law is not codified in a single code. It combines statutes on leases, obligations, family, succession and property with the usages and customs of the Principality and the case law of the Tribunal Superior de Justícia. In practice, research on a compensation question means checking both legislation and jurisprudence, while the Codi de procediment civil governs how the claim is pleaded and how costs are applied at the close of proceedings.

What usually goes wrong

Why injury claims in Andorra are easy to get wrong from outside

Three practical difficulties we see most often when a foreign or newly arrived client tries to handle an Andorran injury matter alone.

01

Evidence sits with third parties

Medical notes, police records and employer documents in Andorra are written in Catalan and held by institutions you cannot easily approach yourself. Getting that material into a form the court will accept is the first hurdle, and it is best started early.

02

Deadlines run in business days

Procedural periods in Andorra are counted in dies hàbils: Saturdays, Sundays, public holidays, August and the Christmas period are excluded. A fortnight that looks generous on a calendar can be considerably shorter in practice, and missing a period can end the action.

03

Not every lawyer can act

Practice before the Andorran courts is reserved to advocates admitted to the Col·legi Oficial d’Advocats d’Andorra, and there is no separate procurador to instruct. You need one CADA-admitted lletrat who both represents and pleads your case.

How matching helps

A route to representation that fits the Andorran system

We do not advise on your claim. We identify the right advocate for it and put you in contact, without a fee for the match.

Advocates admitted to the Andorran bar

We match you with lawyers whose admission to the Col·legi Oficial d’Advocats d’Andorra allows them to appear before the Andorran courts, so no step of the case has to be handed to a second professional.

One lawyer from start to finish

Andorra has no separate procurador profession: representation and pleading are exercised by the same lawyer. That means a single point of contact for filings, hearings and settlement discussions.

Clarity on procedure, not guesses

Your lawyer can explain how periods such as the 20 business days for a civil appeal, judicial fees under the 2000 fees law and the free legal aid route apply to your situation, based on Andorran sources rather than general assumptions.

Brief, free and non-committal

You describe what happened in a few lines. We use it to select a lawyer who handles injury work, and you decide whether to instruct. There is no charge for the matching itself and no obligation to continue.

Frequently asked

Questions clients ask about injury claims in Andorra

Do I need a personal injury lawyer in Andorra to bring a claim?

Not in every case. The Codi de procediment civil expressly contemplates processes in which defence and technical assistance by an advocate are not mandatory, and party representation by an advocate is the general rule in contentious proceedings while the Code and special laws define the exceptions. In practice, a claim requiring medical evidence and quantified losses is normally handled by a CADA-admitted advocate.

Which Andorran court will hear my claim?

First-instance and investigation work is carried out by the Batllia d’Andorra. Serious criminal offences fall to the Tribunal de Corts, and the Tribunal Superior de Justícia is the highest instance and hears appeals. The Llei qualificada de la Justícia of 3 September 1993 structures judicial power into civil, criminal and administrative jurisdictions.

Can compensation be claimed within a criminal case?

Andorran law contemplates claims for civil liability brought within criminal proceedings: the Llei de taxes judicials of 22 June 2000 expressly taxes them, while criminal proceedings as such are not subject to the judicial fee. Whether joining your compensation claim to a criminal file is the better route is a tactical question for your lawyer.

How are time limits counted in Andorra?

Procedural periods run in dies hàbils — business days only. Saturdays, Sundays, public holidays, August and the Christmas period are not counted. The length depends on the type of claim: 20 business days to appeal a final civil judgment, 40 business days to challenge a dismissal, and one year for the extinctive prescription of actions arising from the employment contract.

Is everything done in Catalan?

Yes. Catalan is the sole official language of the Andorran State and of judicial activity: proceedings, filings and judgments are in Catalan. For foreign clients this is a practical point to plan for, particularly when documents are being prepared for use before the Andorran courts, and your lawyer can explain what it means for your file.

What does free legal aid cover in Andorra?

The judge grants it by reasoned order to persons who prove insufficient economic resources, weighing income, basic expenses, dependent family members and their patrimonial situation. It covers duty-advocate assistance for a detained person, defence and representation at every stage of the same criminal proceeding, authorised procedural expenses, and free judicial copies and notarial acts. A decision is due within one month.
