Your situation

Why the first step matters so much in Austria

A defective product can leave you with injuries, destroyed property or losses in your business — and with a manufacturer, importer or seller who says it is not their problem. In Austria these disputes are decided by the ordinary courts within a codified civil-law system, where statute determines which court hears the case, when you must be represented and how long you have to act. That is why the sensible first step is not a complaint letter but a clear assessment of your claim by a product liability lawyer in Austria. Describe what happened in a few sentences. We compare your case with Austrian lawyers who handle product-related damage claims and introduce you to the one who fits.

Austria in practice

How product damage claims work in the Austrian system

Austria is a continental civil-law country whose core private-law rules are codified in the General Civil Code (ABGB) of 1811, supported by the Civil Procedure Code (ZPO) and other statutes. The practical questions — which court hears your case, when a lawyer is compulsory and how long you have to act — are therefore answered by legislation, with the Supreme Court guiding uniform interpretation.

How the Austrian courts are organised

The ordinary courts run in four tiers: 113 district courts (Bezirksgerichte), 20 regional courts (Landesgerichte), four higher regional courts (Oberlandesgerichte) and the Supreme Court (Oberster Gerichtshof, OGH) in Vienna as the highest instance in civil matters. Specialised commercial courts sit in Vienna and Graz. The amount in dispute determines which tier hears your claim first.

When you must instruct a Rechtsanwalt

In civil litigation, representation by a lawyer is compulsory before the regional courts and all higher courts, and before a district court where the value in dispute exceeds €5,000 (section 27 ZPO). Below that threshold parties may appear in person. A Rechtsanwalt is entitled to appear before all courts and authorities in Austria.

Time limits that shape the case

Damages claims in tort prescribe after three years under section 1489 ABGB, whereas ordinary contractual claims can be pursued for up to 30 years. Because the legal classification of your claim decides which period applies, the limitation position should be checked at the outset. Your lawyer identifies the correct basis and the moment time began to run.

What court proceedings cost

Court fees (Gerichtsgebühren) are levied under the Court Fees Act and are generally payable when the claim is filed; in civil proceedings they are calculated as a staggered percentage of the value in dispute. The general rule is that the losing party bears the court fees and reimburses the winning party’s costs (sections 40 ff. ZPO).

Legal aid if money is tight

If meeting the costs of proceedings would impair the necessary maintenance of you and your family, the court may grant Verfahrenshilfe on application. It covers exemption from court fees and, in proceedings where a lawyer is required, the free provision of one (sections 63 ff. ZPO). The case must not be frivolous, and aid is repayable if your finances improve.

Who is allowed to call themselves Rechtsanwalt

Practising as a lawyer in Austria requires entry in the list of lawyers kept by one of the nine regional Bar associations, so Bar membership is compulsory and the title Rechtsanwalt is protected by law. Qualification involves a four-year Austrian law degree, five years of practical training and the bar examination before a higher regional court’s board.

The problem

What makes product damage cases hard to handle alone

The difficulties are rarely about the injury itself. They are about who to pursue, what evidence survives and how quickly the paperwork has to move.

01

You cannot tell who is liable

Manufacturer, importer, distributor or the shop that sold it — the chain behind a defective product can be long, and each link tends to point at the next one rather than at itself.

02

The technical evidence disappears

Batches are recalled, stock is destroyed and internal reports are not shared voluntarily. The earlier a lawyer secures the item, the documents and the records, the stronger your position tends to be.

03

The procedural rules are strict

Austrian civil litigation has fixed rules on which court hears a case, when a lawyer is compulsory and when claims prescribe. Missing the right form or the wrong period can end a good case.

How we help

From a messy situation to a first legal assessment

We are not a law firm and we do not advise on outcomes. What we do is remove the search problem so you can speak to the right lawyer quickly.

Described once, matched once

You set out your case in plain language, with no legal terms required. We read it, identify the type of claim and pass it to lawyers who actually handle this work.

Austrian lawyers only

The lawyers we introduce practise in Austria, are entered in a regional Bar association list and are bound by the professional rules that apply to a Rechtsanwalt.

Free and without pressure

Being matched costs you nothing and commits you to nothing. You decide after speaking to the lawyer whether to instruct them or to leave it there.

Built for cross-border cases

If you live outside Austria, bought the product abroad or the company is registered elsewhere in Europe, mention it — lawyers used to cross-border facts are matched accordingly.

Questions and answers

Frequently asked about product liability in Austria

How do I find a product liability lawyer in Austria without wasting weeks?

Describe your case once on our form: what the product was, what happened, when it happened and what losses you suffered. We review the information and introduce you to an Austrian lawyer who handles product-related damage claims. The matching service is free, confidential and does not oblige you to instruct anyone.

Which Austrian court would deal with a claim like mine?

Austria has a four-tier ordinary court system: 113 district courts, 20 regional courts, four higher regional courts and the Supreme Court in Vienna as the highest civil instance. Commercial courts sit in Vienna and Graz. The value in dispute determines the first instance, and larger claims start at a regional court.

Do I have to be represented by a lawyer to bring a claim in Austria?

In civil litigation, representation by a Rechtsanwalt is compulsory before the regional courts and all higher courts, and before a district court where the value in dispute exceeds €5,000 under section 27 ZPO. Below that threshold you may appear in person. A Rechtsanwalt may appear before every court and authority in Austria.

How long do I have to bring a product damage claim?

Damages claims in tort prescribe after three years under section 1489 ABGB, while ordinary contractual claims can be pursued for up to 30 years. Which period applies depends on how your claim is classified, and time may start running before you realise the full extent of the damage. A lawyer should check this early.

What will it cost to pursue the case in Austria?

Court fees are levied under the Court Fees Act, are generally payable when the claim is filed and are calculated as a staggered percentage of the value in dispute. As a general rule the losing party bears the court fees and reimburses the winning side’s costs. Lawyers’ fees follow the Austrian tariff unless another written arrangement is agreed.

Can I get legal aid for a claim in Austria?

The court may grant Verfahrenshilfe if paying for the proceedings would impair the necessary maintenance of you and your family, and the case is not frivolous or without prospect of success. It covers exemption from court fees and, where a lawyer is required, the free provision of one under sections 63 ff. ZPO. Aid is repayable if your finances improve.
