Product liability in the Czech Republic

A defective product, a Czech court and the right representative

A defective product can cause injury, property damage or pure financial loss, and in the Czech Republic such disputes are resolved within the ordinary civil courts. Because Czech private law was recodified in a single Civil Code in force since 1 January 2014, the framework differs from the older case law you may find online. Choosing the right representative matters: only a person registered with the Czech Bar Association may practise as an advokát, and representation by a lawyer is compulsory before the Supreme Court and the Constitutional Court. We do not give legal advice; we listen to your situation and match you with a product liability lawyer in Czech Republic who handles these claims, free of charge and without obligation. You then decide how to proceed.

Local rules

How product liability disputes are handled in the Czech Republic

Czech private law was recodified in a single Civil Code in force since 1 January 2014, so a claim is assessed under a framework that differs from older case law. The points below set out the structures that matter when you pursue a defective-product claim here.

One code for private-law claims

Since 1 January 2014 the whole of Czech private law has been governed by a single Civil Code, Act No. 89/2012 Coll., which repealed the separate Commercial Code and absorbed commercial, family and inheritance law into one text of more than 3,000 sections. Practitioners and clients should not rely on pre-2014 case law or literature without checking that it is still valid.

Which court will hear your claim

The Czech Republic follows the continental civil-law tradition, based on statutory codes rather than judicial precedent. The ordinary courts form a network of district courts and eight regional courts, and both may act as courts of first instance depending on the value and nature of the case; regional courts hear more serious matters and appeals from district courts.

Only an advokát may practise

Under Act No. 85/1996 Coll. only a person registered in the Register of Lawyers kept by the Czech Bar Association may practise as an advokát. Admission requires full legal capacity, a master’s degree in law, three years of practice as an articled clerk and a pass in the bar examination. You can verify registration in the Bar’s public register.

Representation before the higher courts

Representation by a lawyer is not generally compulsory at first instance, where a party may act in person or through any person holding a power of attorney. It is, however, a statutory condition for an extraordinary appeal (dovolání) to the Supreme Court and for a constitutional complaint to the Constitutional Court.

What a civil claim costs

Court fees are set by Act No. 549/1991 Coll. For an action for a monetary performance the fee is generally 5% of the amount claimed, with a minimum of CZK 1,000. A court may exempt a party in whole or in part on grounds of personal circumstances. Lawyers’ fees are freely agreed; Decree No. 177/1996 Coll. provides non-binding reference rates.

Time limits and the constitutional safeguard

General contractual and property claims are subject to a three-year limitation period, with a ten-year long-stop for property rights. Where a final decision of a public authority is said to breach a constitutionally guaranteed right, a constitutional complaint may be filed with the Constitutional Court in Brno within two months of delivery, once all other remedies are exhausted and with mandatory legal representation.

Common difficulties

Why defective-product claims stall in the Czech Republic

Most delays have little to do with the strength of the case and everything to do with the rules, the language and the paperwork.

01

Unclear which rules apply

Czech private law changed fundamentally on 1 January 2014, and much of the guidance online still reflects the repealed Commercial Code. Guessing which text governs your claim costs time you may not have.

02

Costs feel unpredictable

Court fees, expert evidence and the prospect of paying the other side’s costs under the Code of Civil Procedure make budgeting difficult. A Czech lawyer can map the realistic steps before you commit.

03

Language and distance

Pleadings, correspondence and hearings in Czech courts run in Czech. If you live abroad or do not speak the language, coordinating a claim without local professional representation quickly becomes impractical.

Injured abroad? We cover the neighbours too

Products travel across borders, and so do claims. If the manufacturer, importer or seller sits in another European country, we can look for representation there as well as in the Czech Republic.

Questions and answers

Product liability in the Czech Republic: what clients ask

What does a product liability lawyer in Czech Republic actually do?

They assess whether your loss can be pursued in civil proceedings, identify the correct defendant, and prepare the claim for the competent court. They also handle correspondence, evidence and hearings, and they advise on settlement. Because representation by a lawyer is compulsory before the Supreme Court and the Constitutional Court, the same advocate can carry the case through those stages.

Do I need a Czech advokát to bring a claim?

At first instance you may in principle act in person or be represented by anyone holding a power of attorney. Professional representation becomes a statutory condition, however, for an extraordinary appeal (dovolání) to the Supreme Court and for a constitutional complaint. Only a person registered with the Czech Bar Association may practise as an advokát.

How long do I have to claim?

General contractual and property claims are subject to a three-year limitation period, with a ten-year long-stop for property rights. There are shorter and special periods for other matters. Because the starting point depends on the facts, it is worth having your timeline reviewed early rather than assuming you still have time.

What court fees should I expect?

Court fees are governed by Act No. 549/1991 Coll. For an action for a monetary performance the fee is generally 5% of the amount claimed, subject to a minimum of CZK 1,000. A court may exempt a party in whole or in part on grounds of personal circumstances. Lawyers’ fees are freely agreed between lawyer and client.

Can a defective-product dispute reach the Constitutional Court?

Only as a last resort. A constitutional complaint may challenge a final decision of a public authority that allegedly violates a constitutionally guaranteed right, but only after all other remedies have been exhausted. It must be filed within two months of delivery of the final decision, and the complainant must be represented by an advokát.

How do I check that a lawyer is properly qualified?

The Czech Bar Association maintains a public register of lawyers. Admission requires full legal capacity, a master’s degree in law, three years of practice as an articled clerk and a pass in the bar examination, and members are subject to the Bar’s professional and disciplinary rules. You can verify registration there before instructing anyone.
