The problem
Why Polish property tax questions get complicated
Property in Poland can generate tax questions long after the keys change hands: a decision from a tax authority, a demand that arrives after a transaction has already closed, a liability attached to a property you inherited, or a dispute about who is actually liable. Because Poland follows the continental civil-law model and applies EU law directly, the answer usually turns on codified statutes, the wording of an administrative decision and the evidence in the Land and Mortgage Register rather than on a judge’s earlier ruling. A property tax lawyer in Poland reads the decision, checks whether the facts and the legal basis line up, and tells you honestly whether an objection, an appeal to the administrative courts or another route makes sense. We introduce you to a lawyer who handles this work regularly — the first conversation costs you nothing.
Poland in practice
How property tax disputes work in Poland
Polish tax decisions are administrative acts, so the route to challenging them runs through the administrative courts rather than the ordinary civil courts. Below is the framework a lawyer will test your case against, drawn from official Polish and EU sources.
Administrative courts decide tax cases
Administrative cases in Poland are heard by the voivodeship administrative courts (wojewódzkie sądy administracyjne), with appeals going to the Supreme Administrative Court (Naczelny Sąd Administracyjny). A tax decision is challenged first by an administrative appeal and then by a complaint to the administrative court. Ordinary courts deal with civil, family, labour, commercial, bankruptcy and criminal matters instead.
One deadline matters more than any other: 14 days
The verified procedural deadline for an administrative appeal in Poland is 14 days. Miss it and the dispute may end before a court ever sees it, which is why lawyers start by fixing the date the decision was delivered and how. Working out the exact starting point is itself a legal question worth checking before you act.
Two professions can represent you
Poland has two legal professions, the adwokat and the radca prawny, and since 1 July 2015 both hold identical rights of audience before all courts, including the Supreme Administrative Court and the Constitutional Tribunal. Both are compulsory members of their professional self-government. A radca prawny may also practise as an employee under a contract of employment.
Property paperwork runs through the notary
A contract obliging a party to transfer ownership of Polish real property must take the form of a notarial deed, and the same form is required for the transfer itself. Without it, the transaction is null and void. The notary verifies identity and capacity, controls legality and collects the relevant taxes — often the point where tax questions surface.
The Land and Mortgage Register is the reference point
Ownership and rights in rem over Polish property are recorded in the Land and Mortgage Register (księga wieczysta), kept electronically by the district courts on a real-folio basis. Entries carry a presumption of accuracy, and a good-faith acquirer from the registered owner is protected. Since 2017 the registers can be searched online by their KW number.
What representation costs in Poland
Lawyers’ fees in Poland are freely agreed between lawyer and client, with no binding official tariff. Court fees in civil cases follow the Act on Court Costs in Civil Cases, and the sum recoverable for legal representation is capped by reference to Minister of Justice rates. Free legal aid and court-appointed lawyers exist for people of limited means.

Typical situations
What usually brings people to us
Three patterns account for most of the Polish property tax enquiries we receive.
The decision arrived and the clock is running
Tax decisions carry short challenge windows, and the 14-day administrative appeal period is easy to miss when a letter arrives while you are abroad. Delay changes your options, so the first task is to establish the delivery date.
Nobody agrees who owns or owes what
Inherited or jointly held property often leaves several people unsure who is liable and for which period. Entries in the Land and Mortgage Register enjoy a presumption of accuracy, so the register is where a lawyer starts untangling the picture.
You cannot tell whether fighting is worth it
Challenging a decision costs time and money, and no outcome can be promised in advance. A lawyer can set out the legal basis, the available evidence and the realistic routes — an administrative appeal, a court complaint or a negotiated solution — before you commit.
What you get
How matching works for Polish property tax cases
You describe the problem once; we do the sorting and the introductions.
Matched to the right specialism
We do not route property tax questions to general practitioners. You are matched with a lawyer who works on Polish tax and property matters, so the first conversation begins with your facts rather than with a textbook.
Two professions, one standard
Poland’s adwokaci and radcowie prawni have held identical rights of audience before all courts since 1 July 2015. What matters is not the label but whether the lawyer regularly handles administrative tax disputes and court complaints.
Free matching, no obligation
Describing your case costs nothing and commits you to nothing. You decide whether to instruct the lawyer only after hearing how they would approach the decision, the evidence and the procedural deadlines that apply to you.
Straight talk about costs and risk
Polish lawyers agree their fees freely with clients, and recoverable representation costs in litigation are capped by statutory rates. Your lawyer should explain the fee structure and what is realistically recoverable before you commit to anything.
Cross-border
Property in Poland, life elsewhere in Europe
Owners, heirs and landlords dealing with Polish property often live outside the country. Because EU law applies directly in Poland and takes precedence over conflicting national legislation, a lawyer who works across borders can coordinate the Polish file with your advisers at home.
Questions
Property tax and representation in Poland — FAQ
When should I instruct a property tax lawyer in Poland?
As soon as a decision, notice or demand reaches you. The verified administrative appeal window is 14 days, and the starting point depends on when and how the document was delivered. Early advice preserves options — an appeal, a complaint to the administrative court or a negotiated solution — that disappear once the deadline passes.
Which courts hear Polish tax disputes?
Tax decisions are administrative acts, and administrative cases in Poland go to the voivodeship administrative courts (wojewódzkie sądy administracyjne), with appeals to the Supreme Administrative Court (Naczelny Sąd Administracyjny). The ordinary courts handle civil, family, labour, commercial, bankruptcy and criminal matters instead, so choosing the correct forum matters from the outset.
Who can represent me before a Polish court?
Poland has two legal professions, the adwokat and the radca prawny, and both have held equal rights of audience before all courts since 1 July 2015, including the Supreme Administrative Court and the Constitutional Tribunal. Each is a compulsory member of its self-government. In civil proceedings you may act in person, but representation is in practice required in many matters, especially before appellate courts and the Supreme Court.
What does legal representation cost in Poland?
Lawyers’ fees are freely agreed with the client and there is no binding official tariff. Court fees in civil cases follow the Act on Court Costs in Civil Cases, and the amount a winning party may recover for representation is capped by reference to Minister of Justice rates. Free legal aid and court-appointed lawyers are available to people of limited means.
Why does a notary matter for Polish property?
A contract obliging a party to transfer ownership of Polish real property must be concluded as a notarial deed, and the same form is required for the transfer itself. Without that form the transaction is null and void. The notary verifies identity and capacity, controls legality and collects the relevant taxes, which is often where tax questions first appear.
How can I check the status of a Polish property?
Ownership, mortgages and other encumbrances are recorded in the Land and Mortgage Register (księga wieczysta), kept electronically by the district courts, with a separate register for each property. Entries carry a presumption of accuracy, and a good-faith acquirer from the registered owner is protected. Since 2017 the registers can be searched online by KW number.
